CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City <br />Council hereby approves the use of a holding tank on the property per <br />Section 7 of the Septic Code, Design Manual, and further grants variances <br />to Section 10.61, Subdivision 5 (A) and Section 10.61, Subdivision 4 (F) <br />that would permit an expansion of the parking_ area to wi in 5' of the side <br />street lot line instead of the required 50' street setbaux requiring a 45' <br />or 90% setback variance, and approves eight (8) parking stalls at 9'xl6' <br />instead of the required 91x20', and per Section 1C.20, Subdivision 3 (C) <br />grants a conditional use t:a-mit for the continued use of the property by <br />Minnetonka Alano Group, Inc,., a non-profit club, subject to the following <br />conditions: <br />1. The entrance to the parking lot at Fox Street must be paved. The <br />area to be paves; shall be determined by the Public Works Director. <br />2. Applicant must obtain a permit from the City to install the <br />holding tank within the north yard area as shown on the official site <br />plan, revised by Kelsey Architects Drafting, Delano, Minnesota, by <br />Duane Kelsey, dated 8/16/88. <br />3. The eight (8) stalls that measure 9'xl6' along the east side of <br />the building must be marked with appropriate signage designating <br />compact car parking stalls. <br />4. Authorities granted by this resolution run with the property not <br />with the applicant, but are permissive only and must be exercised by <br />application for a building permit within one year of the date of <br />Council approval, or the special conditions of this resolution will <br />expire on that date (August 22, 1989). <br />5. Violation of or nor, -compliance with any of the terms and condi- <br />tions of this resolution shall constitute a violation of the zoning <br />code, shall automatically terminate any authority granted herein, and <br />shall be punishable as a misdemeanor. <br />6. The undersigned applicant has read, understood and hereby agrees <br />to the terms of this resolution and on behalf of himself, his heirs, <br />successors and assigns, hereby agrees to the recording of this <br />resolution in the chain of title of the property. <br />Page 3 of 5 <br />
