A RESOLUTION GRANTING <br />A CONDITIONAL USE PERMIT PER <br />MUNICIPAL ZONING CODE <br />SECTION 10.20, SUBDIVISION 3 (C) <br />AND VARIANCES TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.61, SUBDIVISION 5 (A) AND <br />SECTION 10.61, SUBDIVISION 4 (F) <br />FILE #1265 <br />WHEREAS, Roger A. Koehnen, an authorized representative of the <br />Minnetonka Alano Group, Inc., (hereinafter "the applicant") has an interest <br />in the the property located at 2760 Fox Street within the City of Orono <br />(hereinafter "City") and legally described as follows: <br />Lot 24 and that part of Lot 23 lying West of the East line of Lot 24 <br />extended North, all in Auditor's Subdivision No. 229, Hennepin County, <br />Minnesota (hereinafter "property"); and <br />WHEREAS, the applicant has made application to the City of Orono <br />per Municipal Zoning Code Section 10.20, Subdivision 3 (C) to allow the <br />continued use by the applicant of the property for a non-profit club use, <br />and in conjunction with the upgrading of the site, seeks the following <br />variances: <br />Per Section 10.61, Subdivision 5 (: , - street setback variance is <br />required for the new alignment of th-_ King lot. located 5' from the <br />street side lot line instead of 50' ;uiring a 45' or 90% variance; <br />and <br />Per Section 10.61, Subdivision 4 (F) - Applicant also requires a <br />parking stall size variance for eight (S) stalls measured at 91x16' <br />rather than the required 9'x20'; and <br />Per Section 7 of the Orono Septic Code Design Manual - seeks approval <br />of the City for the use of a holding tank on the site. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #1265. <br />2. The property is located in the RR-1B Single Family Rural <br />Residential Zoning District requiring a minimum of 2 acres of dry <br />contiguous land in area.
