71588.2 <br />ADMINISTRATIVE AND PERSONNEL POLICIES <br />213. PROHIBITED PRACTICES <br />4. As part of the principal of equal opportunity employment, <br />the work environment shall be free from sexual harassment and <br />intimidation. Such conduct interferes with an employee's work <br />performance and creates a hostile or offensive work environment. <br />In carrying out this policy, the City recognizes that sexual <br />harassment is a form of discrimination and as such is subject to <br />applicable state and federal laws. <br />;exual harassment consists of unwelc sexual advances, requests <br />for sexual favors, and other inappropriate verbal or physical <br />contact of a sexual nature when made by any member of the City <br />staff: <br />(a) When submission to such conduct is made, either <br />explicitly or implicitly, a ter:., or condition of an <br />individual's employment, <br />(b) When submission to or rejection of such conduct by <br />an individual is use -s the basis for employment <br />decisions affecting U _ individual, or <br />(c) When such conduct has the purpose or effect of <br />substantially interfering with an individual's <br />.rofessional performance or creating a!n <br />intimidating, hostile, or offensive employment <br />environment. <br />"he City assures al J employees, including (for these: roc; ::ites <br />only) casual, day, or independent contractors, have the right to <br />file c:fiplaint concerning harassment, sc3tiAl or otherwise. If <br />the ' e,np1L:ee' feels that she or he cannot go to their immediate <br />supervisor, he or she may speak to the C�ty Administrator. <br />If a complaint is filed against the City Administrator, the City <br />Co_ :%. 1 shall appoint an --oendent invest•i "aLor to review the <br />complaint and to report dirr,'.iy to the City Council. <br />The City assures that all claims of harassment will be handles' n <br />strictest confidence. <br />The City assures that no - 3liation tri11 fall t-) anyone <br />complaining of ,e• ual or other forms of ha;:assme t, even in those <br />.tistanr,is when, after investigation, the allegations are either <br />unsubst_,ntiated or incorrect.
