Meyer (hereinafter "the applicant") is the <br />owner of the property .located at 4719 North Shore Drive within the City of <br />Orono (hereinafter "City") and legally described as follows: <br />That part of Lot 4, Block 5, Berquist and Wicklund's Park lying <br />Northwesterly of the Southwesterly 14 feet thereof (P.I.D. 07-117-23 <br />32 0016), (hereinafter "the property"); and <br />WHEREAS, the applicant has applied to the City for variances to <br />Municipal Zoning Code Section 10.03, Subdivision 4; Section 10.03, <br />Subdivision 9; and Section 10.03, Subdivision 13 to permit the structural <br />repair of a detached garage located on a let that dces not sustain a <br />principal residence and at a 12' street setback rather than the required <br />30' as doors of the garage open out to the street. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #1281. <br />2. The property is located in the LR-lB Single Family Lakeshore <br />Residential Zoning District requiring a minimum of one acre in area. <br />The property consists of 5,760 s.f. or .13 acres in area. <br />3. The Orono Council reviewed this .application on June 27, 1988 and <br />conceptually recommended approval of the proposed variances based upon <br />the following findings: <br />A) The applicant's engineer has chosen a method of structural <br />repair of the foundation of the detached garage providing the <br />least impact on the fill contained within the foundation walls <br />and the cement slab floor that remains in excellent condition. <br />B) The structure cannot be located on the applicant's homestead <br />property, :ocated 50' to the west, because of the steep <br />topographies adjacent to the street and the documented drainage <br />problems within the sensitive local watershed. ! <br />Page 1 of 4 <br />
