City of OR ONO <br />RESOLUTION Of THE CITY COUNCIL <br />NO. <br />C) The property was under common nwnership with the lots to the <br />west (Lots 5 and 6, Block 5, Berquist and wicklund's Park) at the <br />time the garage was constructed receiving credit foi the <br />principal residence on Lot 6. <br />4. The City Council has considered this application including the <br />findings and recommendations of the Planning Commission, reports by <br />City staff, comments by the applicant and the effect of the proposed <br />variances on the health, safety and welfare of the community. <br />5. The City Council finds that the conditions existing on this <br />property are peculiar to it and do not apply generally to other <br />property in this zoning district• that granting the variances would <br />not adversely affect traffic conditions, light, air nor pose a fire <br />hazard or other danger to neighboring property; would not meroly serve <br />as a convenience to the applicant, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a <br />substantial property right of the applicant; and would be in keeping <br />with the spirit and intent of the Zoning Code and Comprehensive Plan <br />of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the findings noted above, the Orono . <br />City Council hereby grants variances per Municipal Zoning Code Section <br />10.03, Subdivision► 4; Section 10.03, Subdivision 9; and Section 10.03, <br />Subdivision 13 to permit the structural repair of an existing detached <br />garage located on a lot that does not sustain a principal residence and at <br />a 12' street setback rather than the required 30' for garages that have <br />doors that open out onto the street, subject to the following conditions: <br />1. Applicant shall execute a special lot combination formally <br />recognizing the unique relationship between the subject property and <br />applicant's homestead property, currently divided by a single lot <br />under different ownership.. The agreement will also ensure that both <br />the subject lot and applicant's homestead lot are sold as one unit in <br />the future. <br />2. This variance approval shall allow only the repair of the detached <br />garage classified as a hazardous building and in no way grants <br />approval of the construction of other accessory structures on the <br />property, such future construction would require approval 5y the City <br />of Orono. <br />Page 2 of 4 <br />
