•r �- <br /> ORDINANCE NO. 238 <br /> AN ORDINANCE ESTABLISHING A MORATORIUM ON THE <br /> GRANTING OF BUILDING PERMITS, LAND SUBDIVISIONS, <br /> REZONING APPLICATIONS, CONDITIONAL OR SPECIAL <br /> USE PERMITS, VARIANCES, OR OTHER AUTHORITY FOR <br /> ADDITIONAL DEVELOPMENT ON BIG ISLAND, MAHPIYATA <br /> ISLAND OR DEERING ISLAND <br /> THE CITY COUNCIL OF ORONO ORDAINS: <br /> The Municipal Code of the City of Orono is amended by adding <br /> Ordinance No. 23$ to read as follows: <br /> SECTION 1. Statement of Policy. The City Council finds that <br /> the City is presently faced with the potential development or redevelop- <br /> ment of the several Lake Minnetonka islands, which potential has raised <br /> new concern for issues such as riparian rights, surface water boat <br /> density, neighborhood density, public and private lake access, setbacks <br /> and hardcover. Of special concern is the provision of basic public <br /> services to the islands such as police, fire and medical aid, sanitation, <br /> and access safety at all times of the year. The City' s Comprehensive <br /> Plan was updated in June, 19$0 and has been approved by the Metropolitan ' <br /> Council, but zoning and subdivision regulations have not yet been amended <br /> to reflect the policies and provisions of the new plan. The City is in <br /> the midst of complete recodification of all City ordinances, including <br /> complete rewriting of all zoning and subdivision regulations. $ The <br /> Council finds an overwhelming probability that land use controls and <br /> zoning provisions will need to be updated and revised as they apply <br /> to the islands. The Council also finds that such amending is a process <br /> that cannot be accomplished until numerous detailed studies have been <br /> completed and hearings held. During this interim period, it is <br /> desirable that the Council establish guides for the benefit of those <br /> who wish to develop property in order to bring about savings in public <br /> and private expenditures and to provide to the public guides to future <br /> City action. <br /> The Council determines that there is an urgency involved because of the <br /> need to control development during the interim period so that the <br /> benefits of proper planning will not be lost, to prevent development <br /> which may add to the public burden, and to preserve the status quo <br /> pending adoption of these measures so that the City will not be <br /> impaired in its ability to effPctuate the purposes and goals of these <br /> planning efforts. <br />
