wr ��2 2 <br /> 0 dinance No. 238 <br /> Since enactment of an amendment will undoubtedly modify existing <br /> regulations concerning permitted land use and zoning performance standards, <br /> and will result in adoption of new zoning and subdivision regulations, <br /> the granting of various zoning and permit applications during this <br /> interim period would be detrimental to the effectuation of the Comprehensive <br /> Plan and contrary to the purposes of Minnesota Statutes 462. 351 et. seq. <br /> The Council further finds that it would be unwise, improper and unjust <br /> to allow individual development to occur during this study period to <br /> avoid discrimination and unfair advantage to a few to the detriment <br /> of the entire City. Therefore, the City staff and Planning Commission' s <br /> discretionary authority to grant permits or approve applications <br /> described herein shall not be exercised during the limited term of this <br /> ordinance. <br /> SECTION 2 . Authority. Authority for this Moratorium is based <br /> upon Minnesota Laws 1980 Chapter 566 wherein Section 462. 355, Subd. 4, <br /> provides for the adoption of an Interim Ordinance regulating or <br /> restricting development or subdivision in all or a portion of the City <br /> during study and adoption of a new comprehensive plan and/or during the <br /> planning process of amending ordinances and controls. <br /> SECTION 3. Planning Proceedings in Progress. The Metropolitan <br /> Council has approved Orono' s June, 1980 Comprehensive Community Management <br /> Plan. Final supplements and minor corrections are being made prior to <br /> formal City Council adoption of the Plan, which adoption must occur <br /> before December 25, 1981. <br /> The City Council has ordered staff and the Planning Commission to <br /> prepare amendments to the existing zoning and subdivision ordinances <br /> which work has begun. <br /> SECTION 4 . Restrictions on the Granting of Permits and <br /> Other Approvals. No building permits, land <br /> subdivision approvals, rezoning approvals, conditional use or special <br /> use permits, variances or other authority for additional development <br /> in the restricted areas described in Section 6 shall be granted for <br /> any purpose which would be inconsistent with the intent of this <br /> ordinance. Restrictions include, but are not limited to, construction <br /> of the following types of land uses: <br /> A. Single Family Dwellings; new construction or additions <br /> B. Duplexes or Multi-Family Dwellings; new construction <br /> or additions <br /> C. Commercial Development of any sort including new <br /> construction or additions <br /> D. Any fence or accessory building or structure <br />
