(d) No "on sale" or "Sunday sale" license shall be granted <br /> to restaurants or hotels unless they are located in a B-1 <br /> Commercial Business District. <br /> (e) An "On-Sale Wine" license shall be issued only to a <br /> restaurant where meals are regularly served to tables to the <br /> general public and having facilities for seating not less than ' <br /> 25 guests at one time. <br /> 40.055. Conditions Governing Issuance. The following <br /> conditions govern issuance of a license pursuant to this section: <br /> (a) Any police officer, health officer, sanitarian, building <br /> inspector, or any properly designated officer or employee of the <br /> City shall have the unqualified right to enter, inspect and search <br /> the premises of the licensee at any time without warrant. <br /> (b) Changes in the corporate or association officers, <br /> corporate charter, articles of incorporation, by-laws, or partner- <br /> ship agreement, and any changes of ownership or beneficial <br /> interest of sales of stock entitled to be voted at any meeting <br /> of the stockholders of a corporation which results in a change <br /> in voting control of the corporation by the persons owning <br /> shares of stock therein shall be submitted to the City Clerk <br /> within 30 days after such changes are made. In the case of a <br /> corporation, the licensee shall notify the City Clerk when a <br /> person not listed in the application acquires an interest <br /> which, together with that of his spouse, parent, brother, <br /> sister or child, exceed 5$ and shall give all information <br /> about said person as would have been required of said person <br /> had he been listed in the application. Any such changes must <br /> be approved by the City Council. <br /> (c) The business records of the licensee, including <br /> federal and state tax returns, shall be available for inspec- <br /> tion by the City Council, or other duly authorized representa- <br /> tives of the City at all reasonable times. <br /> (d) No sale of intoxicating liquor shall be made to or in <br /> - guest rooms of hotels, unless the rules of such hotels provide <br /> for service of food in guest rooms and unless the sale accom- <br /> panies and is incident to the regular service of ineals to guests <br /> therein. <br /> 40.060. License Fees. The following provisions control <br /> as to license fees and related subjects: <br /> (a) The annual license fee for a license shall be in the <br /> amount prescribed by the current city fee schedule except that <br /> the "On-Sale Wine" license fee shall not exceed one-half of the fee <br /> charged for an "On-Sale" liquor license or $2,000 whichever is less. <br />
