40.035. Application. Every person desiring a license <br /> shall file with the City Clerk a verified written application in <br /> the form and containing the information prescribed by the City <br /> Council. If the application is by a natural person, it shall be <br /> signed and sworn to by such person; if by a corporation, by an . <br /> officer thereof; if by a partnership, by one of the partners; <br /> if by an unincorporated association, by the manager or managing <br /> officer thereof. If the applicant is a partnership, any license, <br /> bond and insurance policy issued shall be in the names of all <br /> the partners. <br /> 40.040 . Expiration and Renewal. Licenses expire on <br /> June 30 of each year. Applications for the renewal of an existing <br /> license shall be made at least 60 days prfor to the date of <br /> expiration of the license and shall be made in such abbreviated <br /> form as the City Council may approve. If, in the judgment of the <br /> City Council good and sufficient cause is shown by any applicant <br /> for his failure to file for a renewal within the time provided, <br /> the City Council may, if the other provisions of this section are <br /> complied with, waive this requirement and grant the application. <br /> 40.045 . Accountant' s Statement. At the earliest pract- <br /> icable time after application is made for the renewal of a license, <br /> and in any event prior to the time that the application is approved <br /> by the City Council, the applicant shall file with the City Clerk <br /> a statement made by a certified public accountant that shows the <br /> total gross sales and the total food sales of the restaurant for <br /> the 12-month period immediately preceding the date for filing <br /> renewal applications. <br /> 40.040. Ineli ibilit for License. Existence of any <br /> of the following conditions render any app icant ineligible for <br /> for receipt of a license: <br /> (a) No license shall be granted, or renewed, for operation <br /> on any pre�ises on which taxes, assessments, or other financial <br /> claims of the City are delinquent and unpaid. <br /> (b) No license shall be issued for the premises owned by <br /> a person to whom a license may not be granted under this section, <br /> except when an owner is ineligible because� he is a minor or an <br /> alien. <br /> (c) No "on sale" or "Sunday sale" license shall be granted <br /> for a restaurant or hotel which does not have a total market value, <br /> including land, building and equipment, of at least $200,000 or <br /> $500,000 respectively as appraised by the City Assessor, except <br /> that the City Council may grant a license where the total market <br /> value is less than the required value on the condition that the <br /> establishment be improved within 5 years to the required market <br /> value, not including an increase in value caused by the original <br /> granting of the liquor license. <br />
