this Code , shall be subject to a fine of not more than $500 or <br /> imprisonment for a period not to exceed 90 days, or both, such <br /> fine and imprisonment pursuant to the provisions of the statutes <br /> of the State of Minnesota, Chapter 335 , Section 5. Each day - <br /> of violation or non-compliance shall constitue a separate offense. <br /> Subdivision 3 : Civil Enforcement. Appropriate actions <br /> and proceedin�s may be taken by law or in equity to prevent any <br /> violation of the provisions of these codes to prevent unlawful <br /> construction, to recover damages, to restrain, correct or <br /> abate a violation, to prevent illegal occupancy of a building, <br /> or to prevent continued use of a non-conforming on-site system, <br /> and these remedies shall be in addition to the penalties des- <br /> cribed above. <br /> SECTION 22 .70 AllOPTION <br /> Subdivision 1 : Inter�retation, Conflict and Separabilitv. <br /> 1 . Minimum Requirements: In their interpretation <br /> and application, the provisions of this code shall be held to <br /> be the minimum requirements for the protection of the public <br /> health, safety, and general welfare. <br /> 2 . Conflict with Public Provisions : This code is <br /> not intended to interfere with, abrogate, or annul any other <br /> ordinance , rule or regulation, statute, or other provision <br /> by law. Where any provision of this code imposes restrictions <br /> different from those imposed by any other provision of this <br /> code or any other oroinance , rule or regulation, or other <br /> provision of law, whichever provisions are more restrictive or <br /> impose higher standards shall control. <br /> 3 . Separability: If any part or provision of this code <br /> or application thereof to any person or circumstances is <br /> adjudged invalid by any court of competent jurisdiction, such <br /> judgment shall be confined in its operation to the part , <br /> provision, or application directly involved in all controversy <br /> in which such judgment shall have been rendered and shall not <br /> affect or impair the validity of the remainder of this code or <br /> the application thereof to other persons or circumstances . The <br /> City Council hereby declares that it would have enacted the <br /> remainder of this code even without any such part, provision, <br /> or application. <br /> Subdivision 2 : Amendments. For the purpose of protecting <br /> the public health, safety , and general welfare, the City Council <br /> may from time to time amend this code. Public hearings on all <br /> proposed amendments shall be held by the city in the manner <br /> prescribed by law. <br /> -17- <br />
