Approval of the conditional use permit/variance to <br />restore the retaining wall within 75' of the lakeshore based <br />on the following findings: <br />1. That the existing retaining wells are in an unsafe <br />conditon. <br />2. That the conditional use permit approval is not a <br />detriment to the health, safety, and welfare, or <br />materially injurious to properties or improvements in <br />the vicinity. <br />3. That it meets all requirements of granting a <br />conditional use permit pursuant to Section 10.09, Subd. <br />6. <br />4. That it meets requirements of granting a variance <br />pursuant to Section 10.08, Subd. 2. <br />Approval is subject to the following conditions: <br />1. Soil erosion control is provided. <br />2. Separate Luilding permit is obtained from the City. <br />B. Approval of the conditional use permit/variance to <br />install a storm drain pipe within 75' of the lake based on <br />the following findings: <br />1. Lakeshore setback area is the only area which has a <br />lower elevation than the area to be protected. <br />2. That the conditional use permit approval is not a <br />detriment to the health, safety, and welfare, or <br />materially injurious to properties or improvements in <br />the vicinity. <br />3. That it meets all requirements of granting a <br />conditional use permit pursuant to Section 10.09, Subd. <br />6. <br />Approval based on the following conditions: <br />1. City Engineer approval of the pipe size. <br />2. Rip rap is provided f rom out let of pipe to <br />shoreline. <br />3. Temporary soil erosion control is provided and <br />maintained until permanent soil erosion control has <br />taken effect.. <br />e <br />
