Applicant has submitted plans <br />showing that the proposal does not fall into the guidelines <br />for unusual land alteration. <br />The revised plan (Exhibit K 6 O) is a major change from the <br />proposed plan first received. <br />Conditional Use Permit/Variance - Land alteration within 75' of <br />lakeshore. <br />Applicant is requesting to install a 6" PVC pipe within 75' <br />of the lakeshore setback (Exhibit M). Applicant is <br />requesting this drainage pipe to remove drainage water from <br />an area with an elevation of 945.5. This area is the lowest <br />on the property outside the 75' setback (see Exhibit- O). <br />This low area is created to maintiain a walkout style house, <br />as stated in staff memo 12-16-87 (Exhibit E). The City <br />Engineer's review is not available cc the time of this <br />report, but will be si. emitted to you at the Plani:ing <br />Commission meeting. <br />Conditional Use Permit - Retaining walls within 75' of lakeshore. <br />Section 10.55, Subd. 8. <br />Applicant is requesting to restore his retaining wall within <br />the 75' setback. These retaining walls must be replaced as <br />it is olu and deteriorated and the condition was worsened by <br />the July 23, 1987 storm (Exhibit L). <br />The applicant is proposing to remove the concrete block wa)1 <br />and replace it with natural stone (Exhibit L). This <br />retaining wall is two tiers high. The lower wall is <br />approximately 65', and the upper wall is approximately 95'. <br />The existing stairs will be removed and new stairway is <br />proposed in the center of the retaining walls. Staff has <br />inspected the site and found that the existir.q retaining <br />walls are in an unsafe condition. <br />Staff Reco� ndation - <br />Staff recommends the following: <br />
