City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />A RESOLUTION GRANTING PRELIMINARY PLAT APPROVAL <br />OF A SUBDIVISION APPLICATION FOR HALTER H. WHITE <br />APPLICATION NO. 1246 <br />WHEREAS, Walter H. White (hereinafter "the applicant") filed a <br />formal subdivision application with the City of Orono (hereinafter "the <br />City") on January 14, 1988 for the platting of two lots of a property <br />legally described on Exhibit A, attached to this resolution, (hereinafter <br />"the property"); and <br />WHEREAS, after due published and mailed notice in accordance with <br />Minnesota Statues 462.358 et. seq. and the City of Orono zoning and <br />Platting Codes, the Orono Planning Commission held a public hearing on <br />February 16, 1988, at which time all persons desiring to be heard <br />concerning this application were given the opportunity to speak thereon; <br />and <br />WHEREAS, at their regular meeting held on March 14, 1988, the <br />Orono City Council considered the subdivision application of the applicant, <br />noting the following findings of fact: <br />1. The property is located within the RR-113 Single Family Rural <br />Residential zoning district requiring a minimum of 2.00 acres of <br />contiguous dry buildable land within each newly created lot. <br />2. The property has a total of 25.1 acres of lands; 8 acres are <br />wetlands. <br />3. This subdivision shall create two lots. Both lots shall be served <br />by an existing driveway. <br />4. A single family residence can be constructed on Lot 1 without the <br />need for any variances. <br />5. The property is already served by an existing sewer service line. <br />Lot 2 is connected to sewer and an existing stub is available for Lot <br />1. <br />6. The M.W.C.C. has confirmed that there is adequate capacity within <br />the existing lines and that the proposed connection will not involve <br />extension of an existing metropolitan line. <br />7. Zoning will remain rural and all development will occur in strict <br />conformance with the rural district requirements including use, lot <br />size, setbacks and all pertinent rural performance standards. <br />R.
