City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />A RESOLUTION GRANTING <br />A CONDITIONAL USE PERMIT PER <br />MUNICIPAL ZONING CODE <br />SECTION 10.44, SUBDIVISION 4 (AM) <br />AND VARIANCES TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.44, SUBDIVISION 6 (E) AND <br />SECTION 10.61, SUBDIVISION 10 (L) <br />FILE #1240 <br />WHEREAS, Richard Plaisted, an authorized agent of S.R. <br />Partnership, (hereinafter "the applicant") has an interest in the property <br />located at 3574 Shoreline Drive within the City of Orono (hereinafter <br />"City") and legally described as Lots 15, 16, and 17, Block 7, Navarre <br />Heights, Hennepin County, Minnesota (hereinafter "property"); and <br />WHEREAS, the applicant has made application to the City of Orono <br />to permit relocating a storage structure, a drive -through window addition <br />on the west side of the existing structure, and install new paving and <br />landscaping per Section 10.44, Subdivision 4 (A)(1) and a variance to <br />Section 10.44, Subdivision 6 (E) requesting a 13' or 31% rear setback <br />variance for the accessory structure allowing a 22' setback instead of the <br />required 351, and a variance to Section 10.61, Subdivision 10 (L) for a <br />parking variance -f 32 stalls or 68% allowing 15 stalls where 47 are <br />required. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #1240. <br />2. The property is located in the B-5, Limited Neighborhood Business <br />Zoning District. <br />3. The property is approximately 20,175 s.f. or .46 acres in area. <br />The B-5 zoning district requires 20,000 s.f. cr .45 acres in area. <br />4. The Orono Planning Commission reviewed this application on <br />February 16, 1988, and recommended approval of a conditional use <br />permit per Section 10.44, Subdivision 4 (A)(1) for the <br />improvement/upgrading of the property as specified above and <br />recommended approval of the proposed variance to Section 10.44, <br />Subdivision 6 (E) for a rear setback variance for the accessory <br />structure of 13' or 37% and a variance to Section 10.61, Subdivision <br />10 (L) for a parking variance of 32 units :)r 68%, based on the <br />following findings: <br />Page 1 of 4 <br />
