City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />A) The property conforms to all lot standards of the B-5 zoning <br />district and the use is a permitted use with a conditional use <br />permit. <br />B) The Dairy Queen use has existed on the property for over 20 <br />years and the City has no record of any problem with the <br />opera ion of '-hat use. <br />C) The prop changes will not involve an intensification of <br />the use but ..�11 provide more efficient use of the site and <br />greater safety for the public who frequent the Dairy Queen. <br />D) The relocated_ structure and controlled egress and ingress to <br />the property will provide a better and safer traffic flow for the <br />site. <br />E) The associated paving and landscaping improvements will be <br />consistent with the upgrading of Coui.ty Road 15. <br />5. The City Council finds that the conditions existing on this pro- <br />perty are peculiar to it and do not apply generally to other property <br />in this zoning district; that granting the variances would not <br />adversely affect traffic conditions, light; air nor pose a fire hazard <br />or other danger to neighboring properties; would not merely serve as a <br />convenience to the applicant, but is necessary to alleviate a demon- <br />strable hardship or difficulty; is necessary to preserve a substantial <br />property right of the applicant; and would he in keeping with the <br />spirit and intent of the Zoning Code and Comprehensive Plan of the <br />City. <br />6. The City Council finds that granting a conditional use permit to <br />the applicant for the proposed improvement will not be detrimental to <br />the health, safety or S!neral welfare of the public, would not <br />adversely affect light, air nor poL,,e a fire hazard or other danger to <br />neighboring properties, nor will it depreciate surrounding property <br />values and that the proposed level of use of the property will be in <br />keeping ,with the intent and objectiv, of the Zoning Code and <br />Comprehensive Plan of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Ba.�ed upon one or more of the above findings, the Orono City <br />Council hereby grants a conditional use permit per Municipal Zoning Code <br />Section 10.44, Subdivision. 4 (A) (1 ) and variances to Sections 10.44, <br />Subdivision F (E) and 10.61, Subdivision 10 W to permit the relocatiln of <br />a storage structure, drive -through window addition on west side of the <br />existing structure, and the instal lation of new paving and I andscpping, <br />subject to the following conditions: <br />Paar� 2 of 4 <br />
