A RESOLUTION GRANTING <br />PRELIMINARY APPROVAL OF A <br />SUBDIVISION APPLICATION FOR THOMAS R. BETZ <br />AND MICHAEL C. KROLL <br />FILE NO. 1232 <br />WHEREAS, Thomas R. Betz and Michael C. Kroll (hereinafter "the <br />applicants"), on November 20th, 1987 filed a formal subdivision <br />application with the City of Orono for a division o'.-* five lots of a <br />property legally described as Lots 41 and 42, Auditors Subdivision No. 203, <br />Hennepin County, Minnesota (hereinafter "property"); and <br />WHEREAS, after due published and mailed notice in accordance with <br />Minnesota Statues 462.358 et. seq. and the City of Orono Zoning and <br />Platting Codes, the Orono Planning Commission held public hearings on <br />December 21, 1987 and January 27, 1988, at which times all persons desiring <br />to be heard concerning this application were given the opportunit- to speak <br />thereon; and <br />WHEREAS, at their regular meeting held on February 8th, 1988, the <br />Orono City Council considered the subdivision application of applicants, <br />noting the following findings of fact: <br />1. The property is located within the RR-lB Single Family Rural <br />Residential zoning district requiring a minimum of 2 acres of <br />contiguous dry buildable land within each newly created lot. <br />2. The property contains a total of approximately 22 acres. The <br />retention pond consists of 1.2,595 s.f. or .28 acres in area and shall <br />be excluded from the dry buildable areas of the subdivision. <br />3. The proposed plat contains 5 lots each exceedinc, the 2 acre <br />minimum lot area requirement. <br />4. A 1 1 5 lots sha 1 1 be served by a private road. The location and <br />curb cut for the private road that intersects at Stubbs Bay Road has <br />been approved by the City Engineer. <br />5. All lots meet the required 200' width adjacent to the read and at <br />the rear of the front yard setback line. A single femily residence <br />can be constructed on all proposed lots without the need for any <br />variances. <br />6. Septic testing has confirmed that the newly proposed four lots <br />contain adequate and suitable soils for on -site sewage disposal <br />systems. Lot 1, Block 2, the developed lot, contains adequate area <br />and suitable soils to provide for an alternate sewage disposal system. <br />Page 1 of 4 <br />
