0 <br />ti <br />N <br />PUBLIC PROTECTION <br />the residence, or the owner or manager in charge <br />of the establishment or premises at which an <br />animal remains, or to which it returns. <br />(Code 1984, § 9.13(l); Code 2003, § 62-1) <br />Sec. 5.28.020. Interference with officers <br />prohibited. <br />It is unlawful for the owner of any dog to <br />interfere with any police officer or other city <br />employee in the performance of his duty to <br />enforce this chapter. <br />(Code 2003, § 62-2; Ord. No. 137(2nd series), <br />§ 9.12(11(3)), 7-24-1995) <br />Sec. 5.28.030. Keeping. <br />It is unlawful for any person to keep or harbor <br />any animal, not in transit, except: <br />(1) Farm animals kept in accordance with <br />chapter 6.12; <br />(2) Animals kept as part of a show licensed <br />under this Code; <br />(3) Animals used in a parade for which a <br />permit has been issued; <br />(4) Animals kept in a laboratory for scientific <br />or experimental purposes; or <br />(5) Animals kept in an animal hospital or <br />clinic for treatment by a licensed <br />veterinarian. <br />(Code 1984, § 9.13(2); Code 2003, § 62-3) <br />Sec. 5.28.040. Animals in transit. <br />It is unlawful for any person to transport <br />animals unless they are: <br />(1) Confined within a vehicle, cage or other <br />means of conveyance; <br />(2) Farm animals being transported in a <br />portion of the city zoned for rural purposes; <br />or <br />(3) Restrained by means of bridles, halters, <br />ropes or other means of individual <br />restraint. <br />(Code 1984, § 9.13(3); Code 2003, § 62-4) <br />§ 5.28.070 <br />Sec. 5.28.050. Animal housing; rodent and <br />pest infestation. <br />It is unlawful for any person to keep any <br />animal in any structure infested by rodents, <br />vermin, flies or insects. <br />(Code 1984, § 9.13(5); Code 2003, § 62-5) <br />Sec. 5.28.060. Trespasses. <br />It is unlawful for any person to herd, drive or <br />ride any animal over and upon any grass, turf, <br />boulevard, city park, cemetery, garden or lot <br />without specific permission from the owner. <br />(Code 1984, § 9.13(6); Code 2003, § 62-6) <br />Sec. 5.28.070. Regulation of horses. <br />(a) The term "horse" as used in this section <br />means any breed of horse, pony, mule or ass. <br />(b) It is unlawful for any person to ride or to <br />drive a horse after the hour of sunset and before <br />the hour of sunrise along or crossing any public <br />way without appropriate lighting or reflectorized <br />clothing. <br />(c) It is unlawful for any person to ride or <br />drive a horse in any public park, beach, golf <br />course or other public property, except within the <br />right-of-way of public streets and highways, and <br />in areas duly designated as trailways or hitching <br />areas. <br />(d) The city administrator shall designate <br />and signpost those areas in public lands, parks <br />and beaches where horses may be ridden and <br />driven. <br />(e) Every person riding a horse or driving a <br />horse-drawn vehicle upon a public street shall be <br />subject to those provisions of this Code applicable <br />to the driver of a motor vehicle, except those <br />provisions which by their nature can have no <br />application. <br />(f) It is unlawful for any person to interfere <br />with any horse being ridden, driven or kept in a <br />lawful manner. <br />(Code 1984, § 9.13(13); Code 2003, § 62-7) <br />CD5:51 <br />
