Time period for permits. <br />Open burning permits are valid for 60 days <br />from the date of issuance. <br />(Code 2003, § 58-191; Ord. No. 167(2nd series), <br />§ 2(9.30(8)), 1-12-1998; Ord. No. 184(3rd series), <br />§ 4, 1-9-2017) <br />Sec. 5.24.1270. Permit holder responsibil- <br />ity. <br />(a) Prior to starting an open burn, the permit <br />holder shall be responsible for confirming that <br />no burning ban or air quality alert is in effect. <br />Every open burn event shall be constantly <br />attended by the permit holder or his competent <br />adult representative. The open burn fire shall be <br />completely extinguished before the permit holder <br />or his representative leaves the site. It is the <br />responsibility of the permit holder to have a <br />valid permit, as required by this division, avail- <br />able for inspection on the site by the city staff, <br />police department, state pollution control agency, <br />or department of natural resources. <br />(b) The permit holder is responsible for compli- <br />ance and implementation of all general condi- <br />tions, special conditions and the burn event <br />safety plan as established in the permit issued. <br />(Code 2003, § 58-192; Ord. Revocation. <br />(a) The open burning permit is subject to <br />revocation at the discretion of the state pollution <br />control agency, department of natural resources, <br />the fire chief, city staff or the police department. <br />Reasons for revocation include, but are not limited <br />to: <br />(1) A fire hazard existing or developing during <br />the course of the burn; <br />(2) Any of the conditions of the permit being <br />violated during the course of the burn; <br />(3) Pollution or nuisance conditions develop- <br />ing during the course of the burn; <br />(4) A fire smoldering with no flame present; <br />or <br />(5) Burning of materials brought onto the <br />property from another site. <br />(b) Revocation of an open burning permit will <br />result in a six-month moratorium for issuance of <br />open burning permits for the applicant or subject <br />property. <br />(Code 2003, § 58-193; Ord. No. 167(2nd series), <br />§ 2(9.30(11)), 1-12-1998) <br />CHAPTER 5.28. ANIMALS* <br />ARTICLE I. IN GENERAL <br />Sec. 5.28.010. Definitions. <br />The following words, terms and phrases, when <br />used in this chapter, shall have the meanings <br />ascribed to them in this section, except where <br />the context clearly indicates a different meaning: <br />Animals means farm animals and all other <br />animals, reptiles and feathered birds or fowl <br />except dogs, domestic cats, gerbils, hamsters and <br />caged household birds. <br />Dangerous animals means any wild mammal, <br />reptile or fowl which is not naturally tame or <br />gentle but is of a wild nature or disposition and <br />which, because of its size, vicious nature or other <br />characteristics, would constitute a danger to <br />human life or property if it is not kept or <br />maintained in a safe manner or in secure quarters. <br />The term "dangerous animal" also means and <br />includes any domestic mammal, reptile or fowl <br />which, because of its size or vicious propensity or <br />other characteristic, would constitute a danger <br />to human life or property if it is not kept or <br />maintained in a safe manner or in secure quarters. <br />The term "dangerous animal" does not include a <br />dangerous dog as defined in Minn. Stats. § 347.50. <br />Farm animals means cattle, horses, mules, <br />sheep, goats, swine, ponies, ducks, geese, turkeys, <br />chickens, guinea hens and honeybees. <br />Owner means any person who owns, harbors, <br />feeds, boards, keeps or otherwise possesses an <br />animal, and who is the head of the household of <br />*State law references —General authority relative to <br />animals, Minn.
