ti <br />N <br />§ 5.28.080 <br />Sec. 5.28.080. Feeding of waterfowl. <br />ORONO CODE <br />(a) Statement of purpose. It has been <br />determined that the presence of large numbers <br />of wild waterfowl on and around ponds and lakes <br />in the city causes a public health nuisance in and <br />around such ponds and lakes, including the <br />surrounding beaches and properties, which is <br />inimical to the health and general welfare of the <br />public. The purpose of this section is to prevent <br />such conduct that may attract such wild waterfowl <br />to properties in the city. <br />(b) Feeding of wild waterfowl prohibited. No <br />person shall feed, cause to be fed, or provide food <br />for wild waterfowl in the city on lands either <br />publicly or privately owned. <br />(c) Exceptions. This section does not prohibit <br />the temporary care or feeding of a wounded bird <br />on one's own premises. <br />(Code 1984, § 9.13(14); Code 2003, § 62-8) <br />Sec. 5.28.090. Animal limits. <br />No person shall own, harbor, keep or have <br />custody of more than two dogs or more than four <br />cats, over the age of six months, on his property <br />without having first secured a residential kennel <br />license as required in article III, division 3, <br />subdivision II of this chapter, except individuals <br />involved in any animal -related business. Individu- <br />als involved in the business of selling, boarding, <br />breeding, treating or grooming animals must <br />receive a commercial kennel license. Animals <br />which have been specially trained and certified <br />to perform certain tasks, such as for the <br />handicapped, police K-9s, search and rescue, and <br />other designated working animals, are not counted <br />in this requirement, nor are animals that are <br />part of any registered foster parent program. <br />(Code 2003, § 62-9; Ord. No. 208(2nd series), § 8, <br />10-22-2001) <br />Sec. 5.28.100. Noise. <br />(a) Disturbing peace and quiet. No person <br />owning, operating, having charge of or occupying <br />any building or premises shall keep or allow to <br />be kept any animal which shall, by any noise, <br />unreasonably disturb the peace and quiet of any <br />person in the vicinity. The term "unreasonably <br />disturb the peace and quiet" shall include, but is <br />not limited to, the creation of any noise by any <br />animal which can be heard by any person, <br />including the animal control officer or a law <br />enforcement officer, from a location outside of <br />the building or premises where the animal is <br />being kept and which animal noise occurs repeat- <br />edly over at least a five-minute period of time <br />with one minute or less lapse or time between <br />each animal noise during the five-minute period. <br />(b) Complaint. Any person may call or deliver <br />a complaint to the animal control officer, stating <br />facts and circumstances of an alleged violation of <br />this section. The animal control officer shall <br />investigate such complaint. If a violation occurs <br />in the presence of the animal control officer, a <br />summons may be issued. If probable cause of a <br />violation exists, which violation did not occur in <br />the presence of the animal control officer, all <br />reports, witness statements and evidence may be <br />submitted to the city prosecuting attorney for a <br />formal complaint. <br />(Code 2003, § 62-10; Ord. Generally <br />Sec. 5.28.210. Immobilization of animals. <br />For the purpose of enforcement of this chapter, <br />any animal control officer or law enforcement <br />officer may use a so-called tranquilizer gun or <br />other instrument for the purpose of immobilizing <br />and catching an animal. <br />(Code 2003, § 62-41; Ord.
