W) <br />0 <br />§ 1.08.440 <br />ORONO CODE <br />(2) Human resources, responsible for vari- <br />ous personnel management duties, includ- <br />ing such matters as pay and fringe benefit <br />studies, employee grievance procedures <br />and job classification studies; <br />(3) Information technology, responsible for <br />the hardware, software, operating systems <br />and network for all city facilities as well <br />as the maintenance and governance of <br />the city's telecommunication and wire- <br />less networks. <br />(Code 1984, § 2.35; Code 2003, § 2-139; Ord. No. <br />286(3rd series), § 16, 12-11-2023) <br />Sec. 1.08.450. Police department. <br />(a) A police department is hereby established. <br />(b) The police department will be headed by <br />the police chief with responsibilities for ensuring <br />the efficient operation of the police department, <br />seeing that order is maintained, that laws and <br />ordinances are enforced and taking the neces- <br />sary measures to prevent crime and to protect <br />lives and property. The chief of police will be <br />responsible for training, assignment, supervi- <br />sion, and discipline of all department personnel. <br />(Ord. No. 286(3rd series), § 17(2-140), 12-11- <br />2023) <br />Sec. 1.08.460. Fire department. <br />(a) A fire department is hereby established. <br />(b) Council may contract for services. The <br />council may contract with one or more <br />governmental units for fire protection for all or a <br />portion of the city, and, in such case, the follow- <br />ing shall be observed: <br />(1) Fire service districts. The city shall be <br />divided into fire service districts cor- <br />responding to the areas of the city which <br />are provided with fire protection by <br />separate fire departments as established <br />by mutual agreement between the city <br />and one or more contracting municipali- <br />ties. Establishment of such districts shall <br />not preclude or otherwise affect mutual <br />aid agreements between fire depart- <br />ments. An official map shall be prepared <br />and kept current to show all fire service <br />districts in the city. <br />(2) Protected areas. All land within the city <br />shall be included in one of the fire service <br />districts established in subsection (b)(1) <br />of this section and shall be provided with <br />fire protection service by the fire depart- <br />ment having contractual jurisdiction. <br />(3) Jurisdiction. The fire department of the <br />city is the fire department having jurisdic- <br />tion in each of the several fire service <br />districts, and the fire chief is the person <br />holding such position in each such depart- <br />ment. <br />(c) The fire department is led by the city fire <br />chief. <br />(1) The city fire chief shall retain primary <br />responsibility and authority for determin- <br />ing response to fire calls and for fire <br />scene command. <br />(2) The city fire chief shall be responsible for <br />coordinating enforcement policy and <br />activities between the respective fire <br />service districts and the building official. <br />(3) The city fire chief, or their authorized <br />representative, shall be responsible for <br />coordinating enforcement of the fire code <br />set forth in chapter 5.08, with enforce- <br />ment of the state building code adopted <br />in chapters 6.12 and 6.24. <br />(4) Fire prevention. The fire chief may <br />conduct fire prevention inspections or <br />educational programs within the fire <br />service district of each respective fire <br />department consistent with provisions of <br />the fire code, provisions of the applicable <br />fire prevention contract, standard <br />practices of the fire department and <br />applicable provisions of this Code. <br />(d) Right of entry. The members of the fire, <br />police or other city departments shall have the <br />right to enter upon property to investigate a <br />report of or the actual siting of a fire, to take <br />appropriate action to control an illegal fire as <br />defined in chapter 5.24, article IV, or legal fire <br />CU <br />
