The city attorney shall perform such <br />proper control of section activities and to duties as are required of him by law or referred <br />form a basis for the periodic reports to to him by the council. He shall cooperate with, <br />the city administrator. but not be subject to, direction from the city <br />(5) Be responsible for the proper maintenance administrator. Duties include: <br />of all city property and equipment used (1) Appearing for the city in all cases or <br />in their sections. hearings in which it is a party; <br />(6) Cooperate with each other and furnish, <br />upon the request of the city administra- <br />tor, any other department such service, <br />labor and materials as may be <br />requisitioned by the head of such depart- <br />ment, and as its own facilities permit <br />through the same procedure and subject <br />to the same audit and control as other <br />expenditures are incurred. <br />(7) Be responsible for recommending to the <br />city council through the city administra- <br />tor changes in codes, ordinances, and <br />internal organizations which will improve <br />the operations of their sections. <br />(8) Be responsible for submitting an annual <br />budget request to the city administrator <br />which will include proposed additions or <br />deletions in staff, adjustments in salary <br />schedules and additions to plant and <br />equipment. <br />(9) Have responsibility for keeping the city <br />administration advised as to the programs <br />and policies of other governmental agen- <br />cies which might affect the city's opera- <br />tions within their area of responsibility. <br />(10) Have authority to hire subject to the <br />approval of the city council and established <br />civil service rules all part-time and <br />temporary employees for their sections <br />and departments. <br />(Code 1984, § 2.30(1), (5); Code 2003, § 2-140; <br />Ord. Legal department. <br />(a) A legal department is hereby established <br />(b) The council shall appoint a city attorney, <br />who shall be head of the legal department, <br />together with such assistants as may be neces- <br />sary who shall serve at the pleasure of the <br />(2) Advising the council, its committees, or <br />any city officer on all legal questions <br />arising in the conduct of the city's busi- <br />ness; <br />(3) Preparing or revising ordinances when <br />so requested by the council, its commit- <br />tees, or by the city administrator; <br />(4) Performing such additional legal duties <br />as may be necessary upon request; <br />(5) It shall be the official duty of the city <br />attorney to act as revisor of ordinances. <br />(c) The council shall appoint a city prosecut- <br />ing attorney, who shall be responsible for prosecut- <br />ing all penal offenses committed within the city. <br />(Code 1984, § 2.34; Code 2003, § 2-138; Ord. Finance department. <br />(a) A finance department is hereby established. <br />(b) The head of this department shall be the <br />city treasurer and finance officer. It is the duty <br />of the city treasurer and finance officer to maintain <br />complete and accurate records as to all financial <br />matters of the city as required by law. <br />(c) The director of finance who will have <br />responsibilities for financial planning and manage- <br />ment, budgeting preparation and debt manage- <br />ment, staff services to the city administrator and <br />such additional duties as assigned. The director <br />of finance also has the responsibility of invest- <br />ment of city funds as city treasurer. <br />(d) The finance department will have the <br />following sections/responsibilities: <br />(1) Accounting/budgeting, responsible for the <br />control of receipts, accounts payable, fixed <br />assets, special assessments, budgeting, <br />and financial reporting of all city funds. <br />CD1:17 <br />
