N <br />O <br />T_ <br />GOVERNMENT OPERATION <br />administration of all affairs of the city and to <br />that end shall have the power and shall be <br />required to: <br />(1) <br />(2) <br />(3) <br />(4) <br />(5) <br />Supervise the administration of all depart- <br />ments, offices and divisions of the city <br />except as otherwise provided by law and <br />carry out any other responsibilities placed <br />under the administrator's jurisdiction by <br />this chapter or by subsequent council <br />action. The administrator shall interview <br />and screen all prospective city employees <br />as permitted by law and may make recom- <br />mendations to the council before the <br />council makes any appointment. The <br />administrator, with the concurrence of <br />the council, shall appoint department <br />heads, who shall be responsible and <br />accountable to the administrator. All <br />personnel shall be responsible and <br />accountable to the administrator. The <br />city administrator may suspend any <br />employee until the next council meeting. <br />If the city council does not act to modify <br />or rescind the suspension, the suspen- <br />sion shall be deemed ratified by the city <br />council. <br />Develop and issue all administrative poli- <br />cies, rules, regulations and procedures <br />necessary to ensure the proper function- <br />ing of all departments and offices under <br />the administrator's jurisdiction as permit- <br />ted by law and council approval. <br />Prepare and submit an annual budget to <br />the council and keep the council advised <br />of the financial condition of the city and <br />make such recommendations as may from <br />time to time be determined desirable and <br />necessary. <br />Attend and participate in discussions at <br />all meetings of the council and other <br />official bodies as directed by the council. <br />The city administrator shall also represent <br />the city at all official or semiofficial <br />functions as may be directed by the <br />council and not in conflict with the <br />prerogatives of the mayor. <br />See that all laws and provisions of this <br />Code are duly enforced. <br />§ 1.08.360 <br />(6) Make or let purchases and contracts <br />when the amount or nature of claims <br />does not exceed council -approved purchas- <br />ing policies. The city administrator shall <br />receive all other estimates, quotations, <br />sealed bids, purchases or contracts and <br />present them to the council for official <br />action. <br />(7) Recommend from time to time the adop- <br />tion of such measures as he may deem <br />necessary or expedient for the health, <br />safety and welfare of the community or <br />for the improvement of the administra- <br />tion. <br />(8) Perform such other duties as may be <br />required by the council and consistent <br />with state statute and this Code. <br />(Code 1984, § 2.06(4); Code 2003, § 2-100; Ord. <br />No. 182(2nd series), § 1(2.06(4)), 1-25-1999; Ord. <br />No. 286(3rd series), § 10, 12-11-2023) <br />State law reference —Contracts, Minn. General supervisory capac- <br />ity. <br />No member of the council shall in any manner <br />interfere with or prevent the city administrator <br />from exercising the administrator's own judg- <br />ment in the administration of the city. Except for <br />the purpose of inquiry, no member of the council <br />shall deal with or exercise control over the <br />administration of the city; and no member shall <br />give orders to any department head or employee <br />of the city, either publicly or privately, except <br />through a majority vote of the council. <br />(1) If a councilmember receives information <br />regarding a matter of concern related to <br />the administration of the city, the coun- <br />cilmember shall forward the information <br />to the administrator at the earliest pos- <br />sible time. The administrator shall then <br />forward the information to the other <br />councilmembers. <br />(2) If an individual councilmember directly <br />contacts a staff member for the purpose <br />of obtaining information, the information <br />shall be provided to all councilmembers <br />CD1:15 <br />
