r <br />40 <br />r <br />§ 1.08.230 ORONO CODE <br />d. Employees operating any motor Division 2. City Administrator <br />vehicle owned by or operated for the <br />city; Sec. 1.08.310. Position established. <br />Employees directly providing <br />recreation services to the public; <br />f. Employees handling public funds or <br />criminal evidence on a regular basis; <br />g. Employees who have access to non- <br />public information; <br />h. Inspectors, sanitarians, and program <br />specialists; and <br />i. Department heads. <br />(2) Volunteers. Computerized criminal his- <br />tory inquiries and driver's license history <br />inquiries shall be conducted in accordance <br />with this section on persons who are <br />applying to volunteer in city programs <br />that provide services to children or vulner- <br />able adults. <br />(f) Failure of computerized criminal history or <br />driver's license history inquiries. Should the city <br />reject the applicant's request for employment <br />due, partially or solely, to the applicant's prior <br />conviction of a crime, subject to the exception set <br />forth in Minn. Stats. § 364.09, the city administra- <br />tor shall notify the applicant in writing of the <br />grounds and reasons for the denial. <br />(g) Good faith reliance on record accuracy. <br />The city may in good faith rely on the accuracy of <br />the criminal history information received from <br />federal, state, and county authorities in conduct- <br />ing the computerized criminal history or driver's <br />license history inquiry prescribed herein. <br />(h) Verification of identity. Questioned identity <br />situations may occur which could require <br />fingerprint verification where it is not clear if a <br />record based on a name and date of birth search <br />actually belongs to the subject of the computer- <br />ized criminal history or driver's license history <br />inquiry. <br />(Code 2003, § 2-73; Ord. No. <br />182(2nd series), § 1(2.06(1)), 1-25-1999) <br />Sec. 1.08.320. Appointment and removal. <br />The city administrator shall be appointed by <br />the council for an indefinite term. He shall not <br />be removed except by affirmative action taken by <br />the council twice at two regular meetings held <br />within 60 days. The action taken at the first <br />such meeting shall be an expression of intent to <br />vote thereon at the second such regular meeting <br />not to be held sooner than ten days thereafter. If, <br />at any time after the administrator has completed <br />six months of continuous service, the council <br />takes such action, the city administrator may, <br />within 30 days after written notice of removal, <br />request a public hearing which the council must <br />grant and which must be started within 30 days <br />after the request. <br />(Code 1984, § 2.06(2); Code 2003, § 2-97; Ord. Qualifications. <br />The city administrator shall be selected solely <br />on the basis of his executive and administrative <br />qualifications, with special reference both to his <br />experience and formal education, as well as <br />knowledge of accepted practices pertaining to <br />the duties of the office. <br />(Code 1984, § 2.06(3); Code 2003, § 2-98; Ord. Deputy city clerk. <br />The city administrator shall, by virtue of that <br />position, be a deputy city clerk. <br />(Code 1984, § 2.06(6); Code 2003, § 2-99; Ord.
