3. plan A Improvements, <br />A. Tmprovements. The Subdivider will construct and <br />install at Subdivider’s expense Plan A Improvements according to <br />the terms of this agreement and the terms and conditions as set <br />forth in drawings and specifications as listed in Exhibit D <br />attached hereto. If the City should decide not to proceed wif <br />construction of any or all Plan B Improvements as a public project, <br />any such improvement not constructed by the City shall instead be <br />assumed by Subdivider as an additional Plan A Improvement to be <br />designed, installed and constructed by Subdivider at Subdivider’s <br />expense according to the terms set out herein. <br />I>, Construction Plans and Approval Thereof« The <br />Subdivider has engaged at Subdivider’s expense a Minnesota <br />registered civil engineer to prepare detailed plans and <br />specifications for the complete installation of all Plan A <br />Improvements in accordance with City standards, including <br />preparation of estimates, special contract provisions, preparation <br />of proposal forms and designation and description of all necessary <br />temporary and permanent easements. Such plans and specifications <br />are based upon such engineering surveys, including such soil <br />borings and material tests as were determined to be necessary by <br />the City Engineer. Such plans and specifications shall be attached <br />to this agreement as exhibits as set forth in Exhibit D, and shall <br />have been submitted to and have been approved in writing by the <br />City Engineer prior to the execution of this agreement, and/or <br />prior to t’ ^ start of construction of any Plan A Improvement. <br />-3-
