enter into this agreement to provide for among other things, the <br />installation of streets, water, sewer, other utilities, pathways, <br />landscaping, and any other improvements hereinafter described on <br />the terms and conditions hereinafter set forth. <br />MOIf, THEREFORE, in consideration of the premises and of <br />the mutual premises and conditions hereinafter contained, it is <br />hereby agreed as follows: <br />1. A. Warranty of Subdivider, The Subdivider hereby <br />warrants and represents to the City as inducement to the City’s <br />entering into this agreement, that Subdivider's interest in the <br />Subdivision is as set forth on Exhibit C attached hereto. <br />B. Covenants Concerning Titla^ Subdivider hereby <br />warrants that the title to the property in the Subdivision <br />presently and/or as of the time of the filing of the final plat for <br />the Subdivision is as set forth in Exhibit C. <br />2. Improvements. In accordance with the policies and <br />ordinances of the City, the following described public or private <br />improvements (hereinafter collectively called the "Improvements'*) <br />shall be constructed and installed on the terms and conditions <br />hereinafter co*ntained: <br />A. Improvements to be installed by Subdivider at <br />Subdivider's expense shall hereinafter be referred to as "Plan A <br />Improvements". <br />B. Improvements whic.h t’.e Subdivider has petitioned <br />the City to install and finance on an assessment basis shall <br />hereinafter be referred to as "Plan B Improvements". <br />-2-
