The developers are proposing easements for access, drainage, and utilities throughout the <br />common spaces including the drive aisles. A knox box (a secure key box that allows <br />emergency personnel to access a building/site during an emergency) will be required at the <br />entrance gate for emergency personnel and vehicle access. This condition is met. <br />f)The premises shall contain sufficient lighting and/or security measures to deter or mitigate <br />criminal activity and ensure adequate access for emergency response. <br />A lighting plan has been provided. The property is also proposed to be fenced and gated. <br />This condition is met. <br />g)Any individual unit that is connected to the city sewer and water system shall have <br />individual meters. The applicant is proposing individual water and sewer connections to <br />serve building; and each unit will have their own meter. This conditional is met. <br />Section 78-916 Granting of a Permit: <br />Required conditions and policies of a conditional use permit.The burden of proof demonstrating <br />compliance with the following criteria shall be the responsibility of the applicant. In determining <br />whether to approve or deny a conditional use permit, the city council and planning commission shall <br />find that the conditional use permit complies with the following criteria: <br />(a)The planning commission may recommend and the council may grant a conditional use permit as <br />the use permit was applied for or in modified form. On the basis of the application and the <br />evidence submitted, the city must find that the proposed use at the proposed location is or will be: <br />(1)Consistent with the community management plan; The proposed use is consistent with the <br />community management plan. The garage condo proposed use is consistent with the <br />intended Industrial use of the site. <br />(2)Compliant with the zoning code, including any conditions imposed on specific uses as <br />required by article V, division 3 of the City Code; The proposed use meets the requirements of <br />the Code and the Industrial District as a Conditional Use. <br />(3)Adequately served by police, fire, roads, and stormwater management; The site is adequately <br />served by police, fire, roads, and stormwater management. Staff <br />recommends the utilities within the development be privately installed and maintained. The <br />City will have access for shut off or emergency services. The developer will be responsible for <br />installation and maintenance of the utility infrastructure. Each unit will be individually <br />metered to follow the CUP standards. <br />(5)Not expected to generate excessive demand for public services at public cost; The proposed <br />project will be installing a storm pond. The proposed use is not expected to generate <br />excessive demand for public services at public cost based on other similar developments’ <br />historic operating records. <br />97
