Zoning File #1302 <br />April 11/ 1989 <br />Page 2 of 3 <br />The zoning staff has been advised by both John Gerhardson and Glenn <br />Cook that amended Option 2 appears to be the most acceptable for the four <br />residents involved with the repair. Amended Option 2 involves the partial <br />bury of retaining walls along the Erger and Wolfe properties. Schupp's <br />property would have a total bury Erger and Wolfe have requested partial <br />bury so that fill can be restored at grades that would allow re vegetation. <br />The exposed walls per the plans (Exhibit G) show exposure of 5^ to 6*. The <br />Planning Commission conceptually advised a maximum of 5*. Planning <br />Commission should discuss this further with the two property owners. <br />Amended Option 2 no longer includes retaining walls along the Schibilla <br />property, allowing the property to remain as is. <br />Guardrails will be installed in the approximate location as set forth <br />in Exhibits F or G. Cook and Gerhardson have stated that the single cable <br />style with minor alterations has been accepted. Special anchoring will be <br />provided so as not to hinder access to the lakeshore properties. Mike <br />Lynch will be available for comment on the specific assembly of the <br />guardrails. It is staff's understanding that one property owner still has <br />problems with the installation of guardrails. <br />E, <br />As an added note, the Planning Commission is as/^ed to review Exhibit <br />a current letter from Mayor Bedell of Minnetonka Beach, once again <br />reaffirming the City's desire to keep Crystal Bay Road open as a connecting <br />loop road to both cities. <br />It is not clear to the zoning staff whether all four involved property <br />owners have agreed to the proposed amended plan. Mr. Wolfe and Mr. Erger <br />appear to agree to the amended plan. We have yet to receive any clear <br />direction from Schupps or Andersons. Mr. Anderson has advised that he <br />wants to get the matter resolved, but it is not clear whether they approve <br />of Option 2 as amended. In any case, the City is responsible for the <br />repair of the road. Many of the questions raised by the most affected <br />property owners will best be resolved at the Council level with the <br />assistance of the City Attorney. <br />Options of Action Available to the Planning Commission - <br />1. To approve the City of Orono's conditional use permit and variance <br />application for the repair of the roadbed of Crystal Bay Road based on <br />the plan defined as Option 2 as amended by the residents and City <br />Engineer. Approval is based on the following findings: <br />A) The responsibility of the City of Orono to maintain the <br />public health, safety and welfare will require that the road bed <br />be restored to safe public use level. <br />B) The restoration of the roadbed will provide the necessary <br />protection and stability of the public utilities located within <br />the roadway.
