Provide a definition for “Event”: <br />The HOA declaration prohibits any kind of event, gathering, etc. <br />Definition of “event”: Outdoor activities on the Property, such as promotional events, <br />gatherings, demonstrations, displays or other activities which have the potential to <br />materially affect any easement or use rights, cause a nuisance or material disturbance, <br />create a safety or health hazard, create material liability for the Association or any <br />Member, obstruct driveways, access roads, or Common Elements, and otherwise violate any <br />provisions of this Declaration or the Association’s Rules and Regulations shall be prohibited. <br />Staff comment: The above definition of “Event” and appropriate conditions should be incorporated <br />into the Conditional Use Permit so that the City. <br />c. Clarification on “Occupancy” load/number or limitations on the number of individuals <br />allowed within each unit at one time: <br />The occupancy of the building will be determined by the State, building code. The <br />Certificate of Occupancy will be issued once the building is complete. The fire code limits <br />number of individuals permitted in the units following the state fire code. Additionally, the <br />HOA covenants expands on the occupancy for the units. <br />HOA Declaration: The maximum occupancy of each Unit shall be determined in accordance <br />with applicable building, fire, and safety codes as established by the City of Orono or other <br />governing authorities. Owners are responsible for ensuring compliance with these limits, <br />and the Association reserves the right to enforce occupancy restrictions as necessary to <br />maintain safety and compliance with local regulations. Specifically, the Code Diagrams in <br />the architectural drawings specify that the: <br />- 20’x40’ units shall have a maximum occupancy of 3, <br />- 24’x46’ units shall have a maximum occupancy of 4, and <br />- 31’x46’ units shall have a maximum occupancy of 5 <br />Staff comment: “occupancy” in this case does not equate dwelling use, rather it refers to the number <br />of individuals allowed to be within the unit at one time. <br />2.Will there be garbage enclosures? No development garbage facilities are proposed. <br />3. Provide a Maneuverability Plan. Driving paths and turn radius for large trucks, emergency vehicles, <br />trailers (Boats), Parking and Circulation Exhibits provided (see Exhibits). <br />4. Provide a Parking Plan. There will be parking spaces within the units. Each parking space shown is 9' <br />wide and 20' deep per code. Submitted exhibits demonstrates that even if vehicles parked directly <br />across from one another perpendicular to the buildings (which is extremely unlikely) there would <br />still be a code permitted drive lane to pass for emergency vehicles. <br />5. Provide a Fire Lane Turnaround plan for Industrial Boulevard. The updated plans show the <br />availability for a fire turn around within the right of way and abutting property truck entrance. The <br />Orono Fire Chief has reviewed this with no comments. <br />101
