SI ^ <br />conform to the guidelines established by the United States <br />Department of Housing and Urban Development with respect to cost <br />limitations, construction and other standards for development of <br />moderate income dwelling units under the applicable subsidy <br />program(s). The applicant shall furnish any proposal and <br />supporting documents in the form of exchanges of correspondence <br />with responsible officials of the FHA (or other source of subsidy <br />funds), together with affidavits by the proponent reporting its <br />discussions with such officials, indicating, to the extent then <br />possible, whether there are uncommitted funds available for <br />projects to develop low and moderate income dwelling units of the <br />type proposed as well as for other type of units for low and <br />moderate income persons and families. <br />C. Satisfaction of Requirement Without a Subsidy. <br />An applicant may propose to satisfy all or part of th. low and <br />moderate income dwelling unit requirement without u^lizing a <br />government subsidy program; provided, however, that prior to Pinal <br />Plan approval by the Council, the applicant clearly demonstrates <br />and warrants in writing that the proposal will benefit the same <br />nui. b»- of families at the same income levels, and for th« same <br />rentals or prices, which the low and moderate income dwelling unit <br />requirements are intended to assure. <br />D. Architectural Design Requirement. The <br />architectural design of low and moderate income dwelling units will <br />be consistent with the design of the overall MFPR Project and shall <br />not be physically separated, screened or in any manner made <br />identifiable as distinct from the rest of the development. <br />Subd. 13. Hard Cover. The total hard cover on any one <br />MFPR Project shall not exceed 35%. <br />Subd. 14. Recreation and Open Space. MFPR Projects <br />shall contain an adequate amount of land fof park, recreation or <br />local open space use which shall not be less than 10% of the <br />Project area, or the sum of one minimum floor areas based upon the <br />number of bedrooms in Subdivision 16, Subparagraph C below, <br />whichever is greater. The recreation and open space shall be <br />easily accessible to the dwelling unit(s) it is intended to serve. <br />The Project area not eligible to meet this requirement are <br />driveways, parking areas, swamps, drainage areas, sumps, public <br />sidewalks, required yard areas and required lot area required in <br />Subdivision 9 of this Section. <br />Subd. 15. Operating and Maintenance Requirements for <br />Community Recre?ition and Open Space in MFPR Projects. Common open <br />space (defined as that area of the project area set aside for the <br />use and enjoyment of all residents in the Project, including <br />residents of lots within a Project which may be under private <br />ownership and on which lots there may or may not be private open <br />space) shall be subject to requirements in Section 10.32. <br />ORONO CC 294 (4-1-84)O
