LMCCC October minutes <br />Page Two <br />hours per week, starting Thursday, October 18. <br />Rent on the new office space had begun on October 1 ana would <br />continue on a monthly basis. Watts suggested, and it was agreed, <br />that the full commission meeting in November be held in the new <br />apace. <br />Watts reported that Wilczek, Brancel and she had attended the <br />Tonka Bay City Council meeting and the council had agreed to ap <br />prove the budget. The objection had been that budget was not <br />reduced from last year, and they wanted to see more money go <br />into creating new jobs, production and equipment. Minnetrista <br />had also approved the budget. Shorewood and Long Lake had taken <br />no action yet. <br />Watts reminded the Commission that the MACTA conference would <br />be the following Friday and that she and Jim Schindler would be <br />attending, as well as Olds and Wilczek. The LCP-NN conference <br />would be held in Fridley on Saturday, October 20. Watts, <br />Schindler and Hughes-Seamans would attend. A discussion about <br />upcoming conferences followed with no specific plans made. <br />Watts reported that she dio not yet have in all the bids for <br />the 1990 financial review, but would put the item on the agenda <br />when all materials had been collected. <br />Watts said Paul Nazarow would be addressing the issue of late <br />fees during his report, as well as the Patty Ploetz request for <br />X-PRESS X-CHANGE. In addition, there had been five complaints <br />received this month dealing with line extensions, tiering, costs <br />associated with pay packages and the outage cn September 28. <br />Watts had provided the commissioners with copies of the letters <br />she had written to Triax regarding the Regional 6 outage and the <br />outage on September 28 and subsequent problems. The fact that <br />Triax shut the system down during peak viewing times appeared to <br />be contrary to the franchise agreement. Watts had talked to <br />Nazarow about the problem. He acknowledged the mistake and <br />agreed that subscribers who called to complain would receive a <br />credit. It was not clear whether the subsequent bad reception <br />was due to the switch to fiber or other technical problems. <br />Anderson asked what power the franchise agreement gave the com <br />mission in the case of a violation. Watts stated it would <br />depend on the violation. Wright said that subscribers who did <br />not call should also receive credit. <br />Motion 10.16.90.3; Wilczek moved that the Commission direct <br />staff to investigate and document any findings of violation of <br />the franchise agreement and any penalties attached to those <br />violations; and upon agreement by the Commission of violation, <br />penalties be imposed on Triax unless Triax agrees to offer <br />credit to all subscribers affected by the outage of September 28 <br />and 29th. Swartwood seconded the motion, and it passed un <br />animously. <br />IV, UNFINISHED BUSINESS <br />1) Late fee regulation issue <br />Anderson moved to the issue of late fee regulation.
