LMCD Board of Directors October 24, 1990 <br />I':ifc <br />Grathwol moved. Lewman seconded. to* approved Shoreland <br />Protection Chapter IV. <br />Cochran moved, Grathwol seconded, to amend Para^iraph 2, Page <br />47, line 9. to read: To that end the District has proposed a <br />draft ahereiand ordinance A SET UF STANDARDS AND CKiTERlA BASED <br />ON THE DNR STATEWIDE STANDARDS. BUT TAlLURED Tu FIT LAKE <br />MINNETONKA, as the basis for consideration by the cities. Motion <br />carried unanimously. <br />Cochran moved, Grathwol seconded, to delete a and b on <br />Objective 3, Page 53. and amend the objective to read: The LMCD <br />shall counsel with the lake cities by reviewing and commenting on <br />variance applications that affect the shoreland program. <br />In response to Reese’s comment that he believes this is a <br />subjective decision. Harnack stated the current shoreland <br />ordinances require notit,e to the DNR of certain shoreland changes <br />and LMCD would receive the same notice. As an alternative, he <br />suggested a city considering a variance affecting the shoreland <br />send a notice to every community so there is a peer review. In <br />Harnack's judgment use of the LMCD for variance reviews is <br />appropriate. Callahan said this develops another layer of <br />government at the taxpayer’s expense. Rcckvam ob.jected to review <br />of variances within 1000’ of the shore which have no effect on <br />the Lake. Cochran pointed out that the LMCD has no interest in <br />variances that do not impact the shoreland standards and criteria <br />Duane Markus. Waysata resident, requested t-abiing of the <br />motion. . , <br />Malinka raised the i.ssue of additional cost to the cities <br />for additional LMCD staff to conduct variance reviews. Rascop <br />expressed the opinion that there will be very few variance <br />applications that need extensive review. Reese agreed citing his <br />six years experience on the Mound Planning Commission. <br />Martinson stated his opinion that tliere are pr oblems in the <br />area of communication. He does not believe there will extensive <br />additional costs. . » j <br />Steve Cmith. Mayor, Mound, expresseti b.is opinion that <br />use should remain under local control. Ail tourteen communities <br />should get together on shoreland use. Boswmkel expressed the <br />opinion that the cities should have faith in their representative <br />and someone must look to the welfare of the Lake. Vote was called <br />for by the Chair. <br />Motion carried unanimously. <br />Voting aye: <br />(Greenwood);VOTE ON MOTION TO APPROVE CHAPTER IV AS AMENDED: <br />Foster (Deephaven): Grathwol (Excelsior); Cochran <br />Boswinkel (Minnetonka Beach); Lewman (Minnetrista): Reese <br />(Mound); Rascop (Shorewood); Slocum (Woodland). Voting nay: <br />Ptllsbury (Minnetonka); Babcock (Spring Park); <br />(Victoria); Martinson (Wayzata).
