Shoreland <br />Standards and Criteria; and Sections 1* Introduction; VII, <br />Implementation; and VIII Partial List of References Reviewed. <br />Rascop opened the report by stating the sections under <br />consideration were tabled at the 9-26-90 meeting. Written and <br />oral comments were received in the interim. Change.^ and <br />amendments will be discussed. Rascop acknowledged a letter from <br />Jerry Rockvam, Mayor, Spring Park, calling attention to the <br />omission of Paragraph Z. Rascop stated it will be reinsl.ated. <br />H«; then called for comments from the public; on the ent.ire plan. <br />Alan Brixius, Spring Park, submitted a letter dated 10/24/9U <br />in which Spring Park reviews the October 1990 Management Flan <br />draft. Their concern is flexibility in determining lakeshore <br />density. Reinstating Paragraph Z meets at least in part the <br />concerns, Rascop noted, along with further amendments to be <br />proposed at this meeting. The MN DNR has agreed that use of the <br />cities* comprehensive plans may be used as a basis for <br />determining different le\e.:.s of lakeshore density. <br />Speaking for the UNF -.'ohn Stine, Regional Hydrologist, said <br />its plan defines shoreland as lOUU’ f om the water. Their <br />interest is in having the communities we among themselves to <br />get conflicts resolved with LMCD coordination. Local units of <br />government are to map out their own shoreland uses. <br />Edward Callahan, Acting Mayor, Orono. and Mark Bernhardson. <br />City Administrator, Orono. urged tabling the plan. Callahan <br />observed that there are a number of communities whicli object to <br />the plan and when LMCD goes to the legislature to get the power <br />to enforce the shoreland protection policy, those cities will <br />make their ob.lections known. Rascop responded tVat LMCD is not <br />going to the legislature for any authority on uhe shorelaiid. <br />LMCD would like the cities to adopt a shoreland code and then be <br />th^ enforcing agency. The only instance in which LMCD would <br />approach the legislature would be to request funding. <br />Ron Harnack, DNR Divisions of Waters, stated his opinion <br />that this shoreland management plan is a plan of the communities, <br />coordinated with the LMCD. This is a response to the the <br />legislative mandate that all communities adopt a shoreland <br />management plan. The LMCD is an existing structure to assure <br />development of compatible plans for the benefit of the Lake. <br />Al Orsen, Manager, Waysata, stated they have not had time to <br />study the LMCD response to the Waysata plan and rerwain opposed to <br />adoption^^^^^ proceeded with the plan for presentation of the <br />tabled sections. <br />.Pv
