13. On October 3, 1990, staff met with applicanc to review <br />3't3ff*s hArdcove*" deLei., inations and hardcover sketch <br />enclosed as Page __ of this resolution. In addition, the <br />applicant was advised to have a surveyor confirm specific <br />areas of hardcover in question. <br />14. On December 3, 1990, Dennis Johnson submitted a revised <br />survey and revised hardcover facts which now included a 372 <br />s.f. of landscape area underlain with plastic that was never <br />recorded in the original calculations by staff. 154 s.f. of <br />landscape area originally designated on improvements plans <br />for property were not included in updated calculations as <br />these areas do not exist and are not proposed by applicant. <br />The final hardcover was resolved as follows: <br />7.509.45 s.f. or 59% Hardcover existed on property <br />prior to improvements within 1989 <br />6.140.45 s.f. or 49% Proposed hardcover* <br />*2,358.4 s.f. house and garage <br />2,350 s.f. driveway <br />392.05 s.f. sidewalk areas <br />1,040 s.f. deck <br />15. The plans presented for Council's review show lakeside <br />deck encroaching average lakeshore setback by 4*. Applicant <br />did not respond to Council's conceptual direction at July <br />23, 1990 meeting. <br />16. « <br />propos< <br />\ hardcover for property is 3,161.25 s.f. or 25%; <br />40.45 s.f. or 49%. <br />17. The r deck removed prior to approval by the City <br />consis ec 310 s.f. The deck constructed without the <br />benefit o,. .le building permit review and the proposed <br />amended decK are both at 1,040 s.f. in area. <br />18. The applicant proposes new structural hardcover <br />totaling 1,040 s.f. for the matching removal of 1,899 s.f. <br />of non-structural hardcover. <br />19. The applicant and/or applicant's attorney had <br />knowledge of the specific requirements and pertinent <br />standards of both the zoning code and building code <br />requirements prior t'^ construction of the illegal deck.
