6. The Orono Council reviewed this after-the-fact <br />applicatoin on February 12, 199"'; June 25, 1990 ; July 23, <br />1990; and August 13, 1990, <br />7. At the February 12th meeting, Dennis Johnson, the <br />applicant's attorney, "requested that the Council table this <br />matter as opposed to denying it". Council moved to table <br />all action on the application. <br />8. On June 25, 1990, the applicant reintroduced the after- <br />the-fact applicaton before the Council with additional <br />information. Council could not act on this new information <br />because revised plans, submitted by the applicant, had not <br />also been updated on survey information. The application <br />was tabled by Council pending receipt of revised survey <br />locating the revised deck and updated hardcover <br />calculations. <br />9. On July 23, 1990, Council reviewed the updated <br />information submitted by applicant and conceptually denied <br />the after-the-fact variances as proposed by applicant and <br />directed staff to draft the appropriate resolution for <br />formal action by the Council. <br />10. The Council stated that hardcover on the lot is more <br />than double what would be allowed in the ordinances, <br />proposed is at 6,140.45 s.f. or 49%, allowed is 3,161.25 or <br />25%. <br />11. Council also noted that the deck structure encroached <br />the average setback line noting that where excessive <br />variances are sought on a property such as the excessive <br />amount of hardcover existing on this property, if the City <br />had input prior to construction of deck, the average setback <br />line would have been designated and applicant asked to <br />maintain construction behind the average setback line. <br />12. At the August 13th meeting of the Council, the Orono <br />reviewing staff requested that all formal action on the <br />proposal be tabled until staff had time to meet with <br />applicant to review any misundstandings or interpretations <br />of the hardcover facts determined by staff. Council <br />accepted staff's recommendation and once again voted to <br />table the application providing applicant additional time in <br />the review of this after-the-fact application. <br />Page 3 of 6
