Stat. § 412.02, subd. 2a ("All of the provisions of the Minnesota Election <br />Law are applicable to special elections as far as practicable.") <br />3. The petition "shall be filed with ... any judge of the district court in that county <br />in the case of an election for county, municipal, or school district office." Minn. Stat. <br />§ 204B.44(b). <br />4. As detailed herein, on February 10, 2025, the City Council of the City of Orono, <br />which is located in Hennepin County, Minnesota, adopted a resolution calling for a <br />special election when the purported "vacancy" for which the special election was <br />called had already been filled by lawful appointment on November 25, 2024. <br />5. This action, brought under Minn. Stat. § 20413.44, is necessary to correct and <br />enjoin Respondents' unlawful calling and scheduled holding of a special election <br />under circumstances that do not meet the requirements of Minn. Stat. §§ 412.02, <br />subd. 2a or 351.02; namely, there is no current or anticipated vacancy on the Orono <br />City Council. <br />PARTIES <br />6. Petitioner Dennis Walsh is a resident of the City of Orono, Minnesota. He is <br />currently registered to vote and, so, is eligible to vote in the scheduled special election <br />on May 13, 2025.
