Affidavit of Dennis <br />Walsh. <br />7. Respondent City of Orono is a statutory city located in Hennepin County, <br />Minnesota. The governing body of the City of Orono is the City Council. Orono, <br />Minnesota, City Code, Title I, Chapter 1, Section 1-2. The Orono City Council consists <br />of the mayor and four councilmembers. Orono, Minnesota, City Code, Title I, Chapter <br />2, Article III, Section 2-37. <br />8. Respondent Christine Lusian is the City Clerk for the City of Orono. According <br />to Orono, Minnesota, City Code, Title I, Chapter 2, Article IV, Section 2-145(b), the <br />city clerk is the head of the City's administrative department and bears the <br />responsibility for "the administration of elections." She is sued only in her official <br />capacity. <br />FACTUAL BACKGROUND <br />I. In November 2024, Orono Filled the Vacancy Created by <br />Former Council Member Matt Johnson's Resignation. <br />9. Before November 12, 2024, Matt Johnson was a city councilmember on the <br />Orono City Council. <br />10.Johnson was elected in 2022 and was serving a four-year term through 2026. <br />11.On November 12, 2024, Matt Johnson submitted his letter of resignation to the <br />Orono City Council. See Affidavit of James Dickey, Ex. A; see also Minn. Stat. § 351.01 <br />(regarding resignations). <br />12.
