27-CV-25-2808 <br />Filed in District Court <br />State of Minnesota <br />2/15/2025 12:08 PM <br />TO: THE DISTRICT COURT OF HENNEPIN COUNTY: <br />Pursuant to Minnesota Statutes section 204B.44, Petitioner Dennis Walsh <br />petitions the District Court of Hennepin County for an Order quashing Respondent <br />City of Orono's February 10, 2025 order for a special election, Resolution No. 7554, <br />and/or requiring Respondents City of Orono and Orono City Clerk Christine Lusian <br />to cancel and take all action necessary to cancel the special election scheduled to take <br />place on May 13, 2025 for a seat on the Orono City Council, because there is currently <br />no existing or anticipated vacancy for which Respondents may call a special election. <br />Petitioner states and alleges as follows: <br />INTRODUCTION <br />1. Respondent City of Orono violated Minnesota Election Law, and in particular <br />Minnesota Statutes sections 412.02, subd. 2a and 351.02, in calling for a special <br />election for a city council seat when there is no current or anticipated vacancy in any <br />such seat, and Respondents are about to further violate the law unless the Court <br />corrects this wrongful act immediately. The Court should quash the order calling for <br />an election and order the City to cancel its scheduled special election of May 13, 2025, <br />to prevent the unlawful holding of a special election for a council seat currently <br />occupied by a councilmember who has lawful possession of the seat for the remainder <br />of the term through 2026. <br />JURISDICTION <br />2. This Court has jurisdiction over this matter pursuant to Minn. Stat. § 204B.44, <br />which allows "[a]ny individual" to file a petition with the district court asking it to <br />1 <br />56 <br />
