Zoning File #1577 <br />August 15, 1990 <br />Page 2 <br />Discussion <br />The standard tennis court orientation is north/south, hence the <br />slopes on this lot tend to limit the reasonable locations for the <br />standard 60 x 120' tennis court. The proposed location, 5* from the <br />north lot line, is about 60' from the east lot line or 90'+ from the <br />resident structure to the east. The residence to the north is <br />approximately 150' from the tennis court. <br />The applicant has discussed the setback proposal with the <br />property owner to the north, and staff has discussed the plan with the <br />property owner to the east, neither of which has s':ated any specific <br />objections to the project. The neighbor to the east was pleased that <br />the tennis court is proposed to be 60' from their lot line rather than <br />the 30' minimum. <br />Staff would recommend that drainage from the tennis court be <br />directed to the south rather than the east, eliminating the possiblity <br />for any drainage to the neighboring property to the east. <br />The City's current standard for drainage and utility easements <br />along interior lot lines of plats is 5' either side of the line. This <br />plat was done before that standard took effect. However, in <br />discussing this specific easement with the Public Works Director, he <br />feels that there is some potential for future need of the entire 10' <br />easement within applicant's property, for utility purposes, based on <br />the location of the house to the east. His recommendation therefore <br />is to allow a 10' setback from the lot line, but not a 5' setback. <br />Further, the Public Works Director suggested that the City ask for a <br />"Hold-Harmless Agreement" for the entire 30' setback e ;ea, <br />anticipating that if the City needed to install utilities at some <br />future date, the tennis court would possibly encroach into the needed <br />temporary construction easement. <br />The other side of that coin is that we would allow an accessory <br />garage or other accessory structure of normal size, to be located up <br />to 10' from the lot line without such a Hold-Harmless Agreement, <br />hence one could argue that the need for such an Agreement is <br />excessive. <br />Applicant has stock-piled the bags of clay for the clay court, on <br />the cul-de-sac. While the court could be constructed without a <br />variance, that will result in the need for significant retaining walls <br />and additional grading work on the site. <br />Staff Recomnendation <br />Based on the Public Works Director's review of the easement, <br />staff would recommend approval of a 10' minimum setback to the north <br />lot line (with the optional condition for a Hold-Harmless Agreement <br />for portions of the tennis court less than 30' from the lot line).
