Applicant proposes to construct a 60' x 120' tennis court, 5' from <br />his north side lot line where a 30' setback would normally be <br />required. <br />2. The variance is requested due to topography of the site. <br />Applicant requests a 5* lot line setback to keep the bulk of the <br />proposed clay tennis court on the most level area of the lot. <br />(See topographic survey). <br />3. The existing drainage and utility easement is 1J0| either side of <br />the north lot line, hence a 5’ setback would encroach 5* into <br />that easement. <br />4- There is a designated wetland at the very southeast corner of the <br />lot. The proposed tennis court location is in excess of 60' from <br />the wetland. Meeting the required north lot line setback would <br />force the tennis court to within about 35' of the wetland, and <br />result in the need for significant additional grading and the use <br />of retaining walls. <br />5. The existing septic system is directly south of the house, with <br />the alternate drainfield site just east of that. The tennis <br />court as proposed will have no impact on either the existing or <br />future drainfield sites.
