LMCD Board of Directors July 25. 1990 <br />Chandler submitted the following re-wording of Subd.lb <br />as requested by tiie Hennepin County Attorney: Sheriff may order <br />Observer. Whenever it appears in the judgment of the Deputy that <br />the public safety requires an observer, the Deputy may order an <br />operator to provide an observer or to cease all towing activity. <br />The refusal or failure to comply with such an order shall be a <br />misdemeanor. <br />Foster moved, Pillsbury seconded, approval of the third <br />reading of the proposed ordinance. Discussion indicated <br />Boswinkel, Grathwol and Rascop are opposed to the amendment and <br />the necessary eight votes were not available for passage. <br />Foster moved, Grathwol seconded to table the proposed <br />ordinance amendment and to refer it back to the Lake Use <br />Committee. Motion carried unanimously. <br />o) Water Patrol Report <br />Chandler reported on two personal injury accidents. <br />Prosecutions on them with the County Attorney are pending. <br />Chandler said 60 BWIs have been issued, 58 o; them on <br />Lake Minnetonka, including one by the MN DNR Conservation <br />officer. He also stated the five mile "Minnetonka Crossing" swim <br />event was accomplished with no incidents. <br />Pillsbury reported that all except one SunKat pontoon <br />allowed on a special event permit based at Lord Fletchers have <br />been relocate! out of the state. Public interest did not support <br />the operation. <br />5.4. ADVISORY COMMITTEE, Chair Rascop <br />Rascop reported work con.tinues on the final review. <br />The likely last meeting to review responses to the public omment <br />on the Management Plan will be 5:3U p.m., Wednesday, August 1. <br />The Board received a request f'-om David Arndorfer that <br />the retainage on the contract with Arndorfer Associates, Inc. be <br />reduced by $10,000, leaving a balance of $15,000. If approved <br />Arndorfer requested $7,000 be paid to Barr Engineering Ccrr.p--^ ,\y <br />and the balance Arndorfer Associates. <br />Rascor '*='d, Foster seconded, approval of a reduction <br />in the retaina,, n the contract with Arndorfer Associates by <br />$10,000 le 'ing ii5,000 in the contract, subject to receipt of <br />all documents held by the contractor including computer discs. <br />Motion carried unanimously. <br />LeFevere stated the funds could be disbursed as <br />requested by Arndorfer without any liability to the District. <br />5.D.Foster for Chair Cochran <br />1) Reservations were invited from Board members for <br />the Public Officials’ lake inspection tour, Saturday, August 4, <br />10 a.m. to 1 p.m.
