The proposal is consistent with the comprehensive plan. <br /> <br />Conformity with RR-1B Zoning District Standards <br />The property is currently zoned RR-1B One Family Rural Residential (2.0 acre). Lot 1 is proposed to <br />be 3.06 acres and Lot 2 is proposed to be 5.4 acres, meeting the zoning district standard. There are <br />no identified wetlands or bluffs on the property. <br /> <br />Accessory Buildings + Horses <br />The existing property contains a 3,290 square foot barn (the main building is 2,700 with two 270 <br />square foot open-sided “porches” on each side) and a 414 square foot shed. Both of which were <br />used to support horses in the past. The property owners no longer keep horses on the property. The <br />shed on Lot 1 will be removed but they intend to maintain the existing barn for residential storage <br />and personal purposes. <br /> <br />The change in the property’s acreage will make the accessory building footprint nonconforming. A <br />3.06-acre property is permitted a maximum of 2800 square feet of accessory buildings. If approved, <br />the property would not be eligible to have any additional accessory buildings unless the barn is <br />removed or reduced to a conforming size. <br /> <br />Lot 2, proposed to have 5.4 acres, would be allowed a maximum of 4,400 square feet of accessory <br />building footprint(s). <br /> <br />Relationship to Surrounding Development <br />The proposed lots are consistent in both character and size with the neighboring lots. 6th Avenue <br />North is a County Road (CSAH 6) and a major thoroughfare that serves as access to the property. <br /> <br />Conservation Design <br />The requirements of this conservation design ordinance are meant to preserve and enhance the <br />ecological/aesthetic character of properties within the City. The regulations which drive the need for <br />this review are listed within Sections 78-1632 and 82-300 as follows: <br /> <br />Sec. 78-1632. Applicability. <br />The Conservation Design Master Planning requirements of this article apply to all <br />proposed residential subdivisions or multi-unit residential developments greater than five <br />acres in total area or guided for urban density (greater than one unit per two acres). <br /> <br />Sec. 82-300. Conservation design required. <br />The following residential subdivisions shall be subject to the provisions of chapter 78, <br />article XII with regards to conservation design. <br />a. All proposed residential subdivisions greater than five acres in total area and <br />proposing Urban medium or higher densities (greater than three units per acre) <br />b. All proposed residential subdivisions greater than seven acres and proposing two <br />acre minimum lot size or smaller. <br />c. The city council may waive this requirement due to the nature of the proposed <br />subdivision. <br /> <br />As the property is over 8 acres in total area and involves the creation of lots over 2.0 acres, the <br />proposed project does not trigger the requirements for a conservation design. <br /> <br />Utilities <br />The property is not located within the MUSA and therefore not eligible for city sewer.
