A RBSOLOTION GRANTING <br />VARIANCES TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBDIVISION 15 (C), <br />SECTION 10.22, SUBDIVISIONS 1 .AND 2, <br />AND SECTION 10.55, SUBDIVISION 8 <br />FILE #1465 <br />WHEREAS, Gerald T. McCourtney (hereinafter "the applicant") <br />is the owner of property located at 1055 West Ferndale Road within the <br />City of Orono (hereinafter "City") and legally dejcribed as follows: <br />Exhibit A, attached, (hereinafter "the property")?and <br />WHEREAS, the ap^'vicc'.nt has applied to the City for variances <br />to Municipal Zoning Code Section 10.03 Subdivision 15 (C) to allow the <br />construction of a 6' high fence along the street lot line where <br />maximum fence height of 3 1/2' is normally allowed, and a variance to <br />Section 10.22, Subdivision 2 to allow hardcover on the property in <br />excess of the amounts normally allowed, and variances to Section <br />10.22, Subdivision 1 ?.'\d 10.55, St^^division 8, to allow construction <br />of i terrace patio area in the 0-7b' lakeshore setbaclc zone where no <br />.cture or hardcover is normally allowed. <br />Minnesota; <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1.This application was reviewed as Zoning File #1465. <br />2.The property is located in the LR-IA Single Family La)ceshore <br />Residential Zoning District. <br />3.The Orono Planning Commission reviewed this application on <br />June 18,1990 and recommended limited approval of the requested <br />variances based upon the following findings: <br />A) The applicant received 3 separate approvals for <br />hardcover increases in 1987 and 1988, resulting in approvals <br />for 369 square feet additional hardcover over and above that <br />which existed in 1987 and prior years. <br />Page 1 of 7
