B) The applicant intends to place the main floor level <br />of the barn at approximately the same elevation as the <br />main floor of the house, hence as viewed from a <br />distance, the barn will in fact appear no more than <br />approximately 4' higher than the house. <br />C) The proposed barn is more than 75' from all lot <br />lines, and more than 300' from any neighboring <br />residence structure, hence the barn will not overshadow <br />any neighboring residences, nor will affect light, air <br />or open space in the neighborhood. <br />5. Since the Planning Commission meeting, the applicant has <br />revised his proposal to eliminate the basement below the <br />barn, and has lowered the proposed floor elevation of the <br />barn, such that the elevation of the peak of the barn will <br />not exceed the elevation of the peak of the existing <br />residence. <br />6. The City Council has considered this application <br />including the findings and recommendations of the Planning <br />Commission, reports by City staff, comments by the applicant <br />and the effect of the proposed variance on the health, <br />safety and welfare of the community. <br />7. The City Council finds that the conditions existing on <br />this property are peculiar to it and do not apply generally <br />to other property in this zoning district; that granting the <br />variance would not adversely affect traffic conditions, <br />light, air nor pose a fire hazard or other danger to <br />neighboring property; would not merely serve as a <br />convenience to the applicant, but is necessary to alleviate <br />a demonstrable hardship or difficulty; is necessary to <br />preserve a substantial property right of the applicant; and <br />would be in keeping with the spirit and intent of the Zoning <br />Code and Comprehensive Plan of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the findings noted above, the <br />Orono City Council hereby grants a variance to Municipal Zoning <br />Code Section 10.03, Subdivision 9 (B) to ® <br />ore-constructed barn on the property with a defined height 4 <br />higher than the defined height of the principal residence where <br />such accessory structures normally would not be allowed to exceed <br />the height of the principal residence structure, subject to the <br />following conditions; <br />iage 2 of 4
