A RESOLUTIOM GRAHTIN6 <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBDIVISION 9 (B) <br />PILE #1514 <br />WHEREAS, Ronald E. Miller (hereinafter "the applicant") <br />is the owner of the property located at 270 North Willow Drive within <br />the City of Orono (hereinafter "City") and legally described as <br />follows : <br />Exhib * attached (hereinafter "the property"); and <br />WaEREAS, the applicant has applied to the City for a <br />variance to Municipal Zoning Code Section 10.03, Subdivision 9 <br />(B) to allow a pre-constructed barn to be moved onto the <br />property, the defined height of such barn exceeding the defined <br />height of the existing residence on the property by 4', where <br />accessory structures are not normally allowed to exceed the <br />height of the principal structure on the property. <br />HOW, THEREFORE, BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. This applicatijn was reviewed as Zoning File #1514. <br />2. The property is located in the RR-IB Single Family Rural <br />Residential Zoning District. <br />3. The lot area is approximately 3.1 acres, exclusive of <br />road right-of-ways for Willow Drive and the extension of <br />Glendale Drive. <br />4. The Orono Planning Commission reviewed this application <br />on April 16, 1990, and recommended approval of the proposed <br />height variance based upon the following findings; <br />A) Applicant’s existing residence is a 1 story walk <br />out. If applicant had opted to construct a second <br />story on his existing house, the variance would not be <br />necessary. The barn will be located approximately 130' <br />from the house, which decreases the impact of the <br />relative heights of the barn and existing hot»«. <br />Page 1 of 4
