1. This variance approval applies only to the proposed <br />27'x44' barn to be removed from the former Panuska property <br />and brought to the applicant's property. Any other proposed <br />barn structure requiring a height variance will require <br />further review by the City Council. <br />2. Applicant shall adhere to the site plan and grading plan <br />as indicated on the survey by All Metro Land Surveyors dated <br />May 4, 1990. <br />3. Applicant shall execute the appropriate Oversized <br />Accessory Structure Covenant as required by Municipal Zoning <br />Code Section 10.03, Subdivision 9 (C), prior to issuance of <br />a building permit. <br />4. Authorities granted by this resolution run with the <br />property not with the applicant, but are permissive only and <br />must be exercised by application f^r a building permit <br />within one year of the date of Council approval, or this <br />variance will expire on that date (May 14, 1991). <br />5. Violation of or non-compliance with any of the terms and <br />conditions of this variance shall constitute a violation of <br />the zoning code, shall automatically terminate any authority <br />granted herein, and shall be punishable as a misdemeanor. <br />6. The undersigned applicant has read, understood and <br />hereby agrees to the terms of this resolution and on behalf <br />of himself, his heirs, successors and assigns, hereby agrees <br />to the recording of this resolution in the chain of title of <br />the property. <br />Adopted by the City Council of the City of Orono, <br />Minnesota at a regular meeting held on the 14th day of May, 1990. <br />ATTEST: <br />Dorothy M.
