Zoning File #1494 <br />April 4, 1990 <br />Page 3 of 4 <br />Please review the factual findings noted above in comparing <br />the proposal presented for the Planning Commission review at the <br />March 19th meeting and the current proposal presented for Council <br />action this evening. The pool and patio area now encroaches the <br />average setback line by 19' (the existing one encroaches 10' in <br />front of the average setback line). Existing hardcover at 47% is <br />now shown reduced to 42.5%. The applicant has reduced the pool <br />and patio area and the structural addition to the lakeside of the <br />house, thereby requiring no longer a variance to the lot coverage <br />allowance for a lot under 1.99 acres. Please review Exhibit G, a <br />letter presented for consideration by the City at the time of the <br />original proposal in February. Staff has heard nothing from the <br />affected neighbor, but in reading the letter, it would appear <br />that the major concern was the structural addition and its impact <br />on the view windows of their residence. The current application <br />no longer involves an average lakeshore setback variance for a <br />structural addj*-ion, merely the encroachment of a grade level <br />pool and patio by an additional 9* from the existing patio area. <br />Council may wish for additional review comments from the adjacent <br />neighbor prior to formal action. <br />In reviewing Exhibit H, the insurance carrier of the <br />applicant advises that a fence is not necessary around the pool <br />area. If Council approves the encroachment of the average <br />setback line of the pool and patio area, staff would suggest that <br />plantings be provided along the east and west lot lines adjacent <br />to the encroaching pool and patio. <br />The Planning Commission's final vote was confusing to the <br />applicant and was recorded as follows: <br />2 - denial <br />1 - abstention “ made original motion to table but failed <br />1 - approval <br />Options of Action - <br />Approval of amended plan reviewed at April 9, 1990 meeting <br />requiring approval of an average lakeshore setback line of 19' <br />for a proposed pool and patio area and a hardcover variance <br />within the 75-250' setback area for new structural and non- <br />structural improvements within the 75-250' setback area where 47% <br />of existing hardcover exists. The improvements will result in a <br />net reduction of 4.2% hardcover. It should also be noted that <br />structure coverage is maintained at 15%. Approval would be based <br />on the following hardships and findings: <br />1. The property is a narrow, triangular shaped lot <br />preventing expansion to the sides of the existing structure. <br />2. The application as amended will provide no visual impact <br />on the view windows of the adjacent property.
