QHOMlShia.- OwiBziij state(s) that he/she/they is/are the <br />fee owner(s) of real property located in the City of Orono, County <br />of Hennepin, legally described in the attached Exhibit A which is <br />made a part of this document (the "Property"). Owner(s) also <br />state<s) that the following are liens and encumbrances against the <br />property: <br />2. Petition. Owner(s) hereby petition(s) the City of Orono <br />to construct and install a sanitary sewer system (hereinafter <br />referred to as - improvement") within the Stubbs Bay area according <br />to City standards. Owner(s) understand(s) that the entire cost of <br />the Improvement shall be assessed against the Owner(s). <br />3. Improvement. The City, at its sole option, may cause, <br />during 1990-1991, the construction of a sanitary sewer in the <br />Stubbs Bay area, as referenced by a map attached hereto as <br />Exhibit B, and made a part of this document. The general alignment <br />and specifications for the sewer pipe appear in "Specifications for <br />Stubbs Bay Sanitary Sewer Improvements for the City of Orono, <br />Minnesota, Project No. _ 1990", and as they may be amended by <br />the City of Orono (the “Improveraenf*). <br />4. Assessment. At any time after the amount of the expense <br />to be incurred for the Improvement, or one similar thereto <br />determined by the City of Orono: <br />a) The City may at the time it deems appropriate, <br />assess, by special assessment, against the Property a <br />principal amount not to exceed the amount set forth <br />on Page 4 ("Estimated Special Assessment"). <br />b) The Estimated Special Assessment may bear interest at <br />the lawful rate and may be spread over a number of <br />years as deemed necessary by the City.
