c) Th« Estimated Sp«ci«l Assessment shall become a lien against the Property as ueflned in Minnesota Statutes, Chapter 429. <br />d) Ovner(s) waive(s) any ri^ht to appeal from the <br />Estimated Special Assessment, including but not <br />limited to any procedural or substantive right <br />pursuant to Minnesota Statute, Chapter 429, or any <br />other statutes, constitution, laws or judicial <br />decisions of the State of Minnesota jr United States. <br />e) In the event the allocated cost for the Improvement <br />exceeds the Estimated Special Assessment, the City <br />may adopt a larger special assessment or supplemental <br />special assessment. The Owner<s) may appeal only the <br />amount in excess of the Estimated Special Assessment. <br />f) If the City adopts a special assessment against the <br />Property in excess of the Estimated Special <br />Assessment, the City shall provide notice tc the <br />Owner(s) of the proposed adoption of the exce^c <br />assessment in accordance with the procedure set forth <br />i:: Minnesota Statute, S 429.041 and the Owner(s): <br />i> may appeal only the amount in excess of the <br />Estimated Special Assessment; and <br />ii) reserv«(s) the right to appeal therefrom <br />pursuant to the procedures set forth in <br />Minnesota Statute, S 429.081. <br />g) Any appeal taken by the Owner(s) pursuant to <br />para -aph f) hereof shall only be as to the amount of <br />exce..d assessment and shall not include any appeal <br />from the procedures followed by the City which might <br />otherwise have been reguired under Minnesota <br />Statutes, Chapter 429. <br />5. ttOflA-UB Tq Stwer. Upon future hook>up to the sewer pipe, <br />Owner(s) shall pay those additional costs which are related <br />thereto.
