1 <br /> <br /> <br />AGREEMENT FOR SEWER LINE RELOCATION <br /> <br /> This agreement (the “Agreement”) is made and entered into this ______ day of <br />_____________ 2024, by and between Scott and Lori Gengler (“Owner”) and the City of <br />Orono, a Minnesota municipal corporation (“City”). <br /> <br />WHEREAS, Owner is the fee owner of property with a street address of 4215 <br />Forest Lake Drive, Orono, Minnesota, legally described as: <br /> <br />Lot 4, Block 3, Forest Arms Country Club Addition, Hennepin County, Minnesota. <br />(“Property”). <br />WHEREAS, City is a municipal corporation of the State of Minnesota authorized <br />by statute to establish, operate and maintain sewer systems for the benefit of the public; <br />and <br /> <br />WHEREAS, a public sewer line is on the Property; and <br /> <br />WHEREAS, Owner wishes to construct a new house on Property in a different <br />location; and <br /> <br />WHEREAS, Owner has requested that he be permitted to relocate the City’s <br />sewer line to facilitate the new home location; and <br /> <br />WHEREAS, City and Owner wish to cooperate to develop a plan to realign the <br />sewer line to the new home location; and <br /> <br />WHEREAS, this Agreement defines the roles and responsibilities for each party <br />regarding the sewer relocation. <br /> <br />NOW THEREFORE, in consideration of the mutual covenants herein, and other <br />good and valuable consideration, the sufficiency of which is hereby acknowledged, City <br />and Owner agree as follows: <br /> <br />1. EXISTING SEWER LINE. The City will abandon the existing sewer line <br />on the Property. The Owner will remove the current sewer pipe and manholes. <br /> <br /> 2. REPLACEMENT SEWER LINE. The Owner will design, construct and <br />pay for a new sewer line to be installed along the northwestern side of the Property as <br />depicted in exhibit A. <br /> <br />3. EASEMENTS. Owner will provide at no cost to the City a permanent utility <br />easements in favor of the City. The owners surveyor /engineer will provide the easement <br />exhibits. The City will draft the easement documents, Owner will secure signatures for <br />the easement, and the City will record the easements. The easements must be signed prior <br />to the commencement of any work on sewer line relocation. <br />154
