Berohardsonf bereloafter called "EMPLOYEE" as party of <br />partp both of wbom understand as follows: <br />and <br />the second <br />WITNESSETH: <br />WHEREAS, the CITY desires to employ the services of Mark E. Bernhardson as <br />City Admloletrator of the CITY OF ORONO; <br />WHEREAS, It is the desire of the CITY to provide certain benefits, <br />establish certain conditions of employment, and to set working conditions <br />of said EMPLOYEE; and <br />WHEREAS, EMPLOYEE desires to serve In the employment of said CITY as the <br />City Adainistrator: <br />NOW THEREFORE, in consideration of the mutual covenants herein contained, <br />the parties hereto agree as follows: <br />SECTION I: DOTIES <br />Aw The CITY OF ORONO hereby agrees to employ Mark E. Bernhardson as City <br />Adainistrator of said CITY to perform the function and duties specified <br />in the position of City Administrator. <br />SECTION II: TERM <br />Aw The term of this written employment contract shall be four years <br />beginning May 1, 1985. The EMPLOYEE and the CITY OF ORONO shall have <br />the option to extend this agreement as provided in SECTION XII, B. <br />B.The EMPLOYEE shall only be terminated for cause after written notice of <br />charges delivered to the EMPLOYEE. EMPLOYEE Is entitled to a hearing <br />by the full City Council on request. <br />C.The EMPLOYEE may resign only after two months' prior notice In writing <br />unless this time requirement is waived by the City Council. <br />8ECT10M Hit TERMINATION AND SEVERANCE PAT <br />A.In the event EMPLOYEE is terminated by the City Council pursuant to <br />SECTION II, B, and said EMPLOYEE is willing and able to continue to <br />perform the duties of the City Administrator, the CITY agrees to pay <br />EMPLOYEE a lump sum cash payment equal to <br />six months gross salary, including all insurance benefits, if <br />involuntary termination takes place during the first year of <br />employMot, <br />five months gross salary, including all insurance benefits, if <br />involuntary termination takes place during the second year of <br />employment. <br />four months gross salary, Including all insurance benefits, if <br />involuntary termination takes place during the third year of <br />employment, <br />-1- <br />m <br />\
